Article 40 Restrictions on appointment of examiners

In any of the following situations, an examiner shall not examine a trademark application:

1. where the examiner's spouse, former spouse or betrothed is the applicant or trademark agent thereof;

2. where the examiner is or has in the past been related to the applicant by consanguinity up to and including the fifth degree or by affinity up to and including the third degree;

3. where the examiner is or has in the past been the head of the applicant's family or a member thereof, or serves or has served as the applicant's legal representative;

4. where the examiner has in the past served as the applicant's trademark agent; and

5. where the examiner has a direct interest in the financial affairs of the applicant. [loi des marques de TW]
