FOREWORD 1 - PURPOSE

To establish requirements for transportation and storage, in open sea, of packaged

dangerous cargoes, solid dangerous cargoes in bulk, noxious liquid substances in bulk and liquefied gases in bulk, aiming at the safety of persons and integrity of vessels and minimizing risks to the environment.

2 - APPLICATION

These Standards apply to Brazilian-flagged vessels operating in open sea and foreign

vessels carrying cargoes addressed in the previous item when in Brazilian ports. Special attention must be paid to the specific application of each chapter of these

Standards.

CHAPTER 1

TRANSPORTATION OF PACKAGED DANGEROUS GOODS

0100 - APPLICATION

This chapter applies to all Brazilian-flagged vessels with gross tonnage above 20 when carrying a dangerous cargo, and foreign-flagged vessels subject to compliance with the SOLAS 74 Convention, as amended, in what relates solely to provisions of items 0101, 0105 (except subparagraph e), 0107 and 0108.

Foreign-flagged vessels authorized to operate in Brazilian Jurisdictional Waters by temporary enrollment shall fully meet this chapter's provisions, as set forth in NORMAM 04/DPC.

0101 - APPLICABLE REGULATIONS

The maritime transportation of packaged dangerous cargoes in Brazilian- or foreign-flagged vessels shall meet the following regulations, where applicable:

a) International Convention for the Safety of Life at Sea 1974 - SOLAS/74, as amended;

b) International Maritime Dangerous Goods Code - IMDG Code as amended; c) International Convention for the Prevention of Pollution from Ships - MARPOL

73/78, Annex III, where applicable; d) International Code for the Safe Carriage of Packaged Irradiated Nuclear Fuel,

Plutonium and High-Level Radioactive Wastes on Board Ships - INF Code; e) Radioactive Materials Transportation Standard, from the National Commission of

Nuclear Energy (CNEN) - CNEN-NE 5.01/88; and f) Medical First Aid Guide for Use in Accidents Involving Dangerous Goods -

MFAG, adopted by the IMO MSC/Circ.857 or by any other superseding it; g) Emergency Response Procedures for Ships Carrying Dangerous Goods - EmS

Guide, adopted by the IMO MSC/Circ. 1025 or by any other superseding it; 0102 - DEFINITIONS

For the exclusive effect of application of this chapter, the following definitions are here adopted:

a) Dangerous Cargoes - means cargoes which by being explosive, compressed or liquefied gases, flammable, oxidant, venomous, infecting agents, radioactive, corrosive or contaminating substances, may present risks to the crew, the ship, the port facilities or to the aquatic environment. The dangerous goods here defined are listed in the international conventions and codes published by the IMO.

b) Intermediate Bulk Container - IBC - means rigid, semi-rigid or flexible portable packages which do not fit the package specifications mentioned in subparagraph c) and have a capacity equal to or lower than 3 m3 (3000 liters). They are designed for mechanical handling and to withstand the efforts due to the handling and transportation. This requirement shall be verified through specific essays (approval process).

c) Packages - means the enclosures or containers of approved types intended for

containing dangerous goods, dealt with in Annex I of the IMDG Code. d) Massive Explosion - means one that affects almost all the cargo, instantly. e) UN Number - means a number assigned by the United Nations Committee of

Experts on Transportation of Dangerous Goods to each product or substance, for its identification.

f) Cargo Transport Unit - means a cargo road vehicle, cargo railway wagon, cargo container, tank road vehicle, and tank railway wagon

g) Harmful Substances - means those substances identified as marine pollutants in the International Maritime Dangerous Goods Code (IMDG Code), or fitting the criteria set forth in the appendix of Annex III of the MARPOL 73/78 Convention, as amended.

h) SOLAS Vessels - means all Brazilian-flagged merchant vessels engaged in international maritime voyages or employed in the merchant maritime traffic among Brazilian ports, oceanic islands, port terminals and offshore platforms, with exception of:

- cargo vessels with GT<500; - vessels carrying more than 12 passengers, with GT<500 and not engaged in

international voyages; - wooden vessels of primitive construction; - vessels with no mechanical propulsion means; and - fishing vessels.

0103 - CLASSIFICATION OF DANGEROUS GOODS

For the purpose of this Chapter, dangerous goods are divided in classes according to their characteristics, as follows:

a) CLASS 1 - Explosives Class 1 is characterized by the fact that the type of packaging/casing is, in many

cases, a risk determining factor and, therefore, depends on the division the substance fits in.

This class has five subdivisions, corresponding to the distinct risks presented, as follows:

1) Division 1.1 - substances or products presenting a risk of massive explosion.

2) Division 1.2 - substances or products presenting a risk of projection, but not a risk of massive explosion

3) Division 1.3 - substances or products presenting a risk of fire and risk of producing small shock wave effects or projection or both effects, but not presenting risk of massive explosion. Comprehending substances or goods which:

I) ignite with great irradiation of heat, and II) burn sequentially, but without risk of projections or shock.

4) Division 1.4 - substances or products not presenting a considerable risk. The

effects are restricted to the package, without projection of fragments at considerable distances. The package’s external fire is not expected to cause any explosion.

5) Division 1.5 - substances highly insensitive but presenting a risk of massive

explosion.

The substances in this division present a risk of massive explosion but are so insensitive that, in normal conditions of transportation, they present little probability of initiating a combustion or that its combustion may originate a detonation.

Note: It is more probable that the combustion may originate a detonation when the ship carries great volumes of these substances. In these cases, the substance must be considered as pertaining to Division 1.1 in what concerns to stowage.

6) Division 1.6 - highly insensitive substances, not presenting a risk of massive explosion.

b) CLASS 2 - Compressed, liquefied or dissolved gases under pressure 1) Class 2.1 - Flammable gases; 2) Class 2.2 - Non-flammable and non-toxic gases; and 3) Class 2.3 - Toxic gases.

c) CLASS 3 - Flammable liquids These are mixtures of liquids, or liquids containing solids in solution or

suspension (e.g. paints and varnishes) which emanate flammable vapors at temperatures below 61o C (in a closed crucible test) or 65.6o C (open crucible test), often referred to as flash point.

d) CLASS 4 - Flammable solids 1) Class 4.1 - Flammable solids (easily combustible); 2) Class 4.2 - Substances subject to spontaneous combustion; and 3) Class 4.3 - Substances that emit flammable gases when in contact with water.

e) CLASS 5 - Oxidizing Substances and Organic Peroxides 1) Class 5.1 - Oxidizing Substances - substances that, in separate, are not

necessarily combustible and may, in contact with oxygen, cause or contribute to cause a combustion of other materials; and

2) Class 5.2 - Organic Peroxides - substances thermally unstable, which may produce an exothermic auto-decomposition.

f) CLASS 6 - Toxic or Infecting Substances 1) Class 6.1 - Toxic substances - substances capable of causing death, serious

wounds or health damages when inhaled, ingested or placed in contact with the skin; and 2) Class 6.2 - Infecting substances - substances containing live microorganisms

or their toxins, which cause or are suspected to cause sicknesses in animals or human beings.

g) CLASS 7 - Radioactive Substances Means substances that emit radiation. Their transportation shall be made in

accordance with standards of the National Commission of Nuclear Energy (CNEN). h) CLASS 8 - Corrosive Substances

Means the substances that, through chemical action, cause damage when in contact with live tissue or, when spilled, cause damages to the ship or to other cargoes.

i) CLASS 9 - Miscellaneous Dangerous Substances and Materials Means the dangerous substances and materials that do not fit in the remaining

classes. They include, also, the products classified as sea pollutants, which

represent risk to the aquatic environment in the case of a spill.

0104 - REQUIREMENTS FOR THE CARRIAGE OF PACKAGED DANGEROUS GOODS The IMO Code IMDG governs the packaging, segregation, marking, tagging and

labeling of packaged dangerous goods. a) Packaging Approval

The national packagings shall be approved and certified by the DPC, who shall issue the competent approval certificate. This certificate will show the UN marking to be placed on the packagings.

When the packaging is originated from other countries, it must have the respective UN marking of approval by the originating country.

b) Statement of Dangerous Goods The shipper of a dangerous good shall present a Statement of Dangerous

Goods following the model form contained in Annex 1-A, which shall accompany the Cargo Manifest to verify that the cargo, as delivered for transportation, is properly packaged, marked, tagged and signaled in compliance with the applicable requirements. The shipper is responsible for the compatibility between packaged product and approved packaging.

The ship shall neither receive nor carry the cargo without the shipper's compliance with this subparagraph.

The ship shall not set sail from the cargo destination port without removal from board of the dangerous good, as stated in Annex 1-A.

When the cargo is transported in containers or inside vehicles, the person responsible for its stowage shall also sign a statement shown in the appropriate field of the model in Annex 1-A.

c) Radioactive Cargoes 1) Ships carrying radioactive goods shall submit, for admission to the port, the

documentation provided for in standard CNEN-NE 5.01/88 and subsequent updates, issued by the National Commission of Nuclear Energy.

2) The cargoes shall meet these materials' segregation standards contained in the IMDG, including the applicable seclusion distances;

3) For the berthing or sailing clearance of a ship with Class 7 goods - radioactive cargoes, by the Harbormaster (CP), Delegate (DL) or Agent (AG) office, the respective authorization by the CNEN shall be submitted. The loading or unloading of such products shall be preceded by the adoption of safety measures indicated by a competent person qualified on radiological protection. By competent person in this case, it is understood a Radiological Protection Supervisor - SPR, qualified in accordance with the CNEN Resolution 111/11 - Certification for the Qualification of Radiological Protection Supervisors, and subsequent updates;

4) The International Code for the Safe Carriage of Packaged Irradiated Nuclear Fuel, Plutonium and High-Level Radioactive Wastes on Board Ships (INF Code) shall be observed where applicable, and under coordination by CNEN specialists.

d) Dangerous Goods Manifest (Cargo Manifest) On occasion of the vessel's dispatch, a list must be delivered to the CP, DL or

AG office with all the dangerous goods on board , their quantities, packaging types, UN numbers, class and location on board, following the model form shown in Annex 1-B.

A detailed stowage plan identifying the dangerous goods on board by class and indicating their locations shall be accepted in replacement for the Cargo Manifest.

Vessels under time clearance as, for example, those engaged in offshore support navigation, shall keep on board a Stowage Plan of

Dangerous Cargoes or a duly updated Cargo Manifest. Such document is not required to be submitted to the CP/DL/AG office and is valid throughout the vessel clearance's validity period.

e) License for the Carriage of Dangerous Goods This license is applicable to all Brazilian-flagged vessels that engage in the

carriage of dangerous goods. The vessel's Master shall submit the application for a transport license by means of a term of responsibility as shown in Annex 1-C, stating that all requirements relating with the packaging, the packager, documentation, marking, tagging, strapping and segregation of the transported dangerous goods have been met.

When the transportation is effected on a SOLAS vessel, as defined in item 0102 subparagraph h), a copy of the Document of Compliance related to the special requirements for transportation of dangerous goods shall be submitted together with the license request, as required by Regulation 19.4 of Chapter II-2 of SOLAS-74, as amended, except for dangerous goods of classes 6.2 and 7 and for the carriage of dangerous goods in limited quantities as provided for in Chapter 3.4 of the IMDG Code.

The license will be the term of responsibility itself, after initialed in the proper field by the CP, DL or AG office representative. This license shall be valid for all subsequent ports, if there is no further embarkation of other dangerous goods.

For vessels under time clearance as, for example, those engaged in offshore support navigation, the license shall be requested to the CP/DL/AG office just once for each of the vessel's clearance period. Such document will remain valid throughout the vessel clearance's validity period. However, the Cargo Manifest shall be kept up-to-date as set forth in subparagraph d) of this item.

f) Denomination of Dangerous Cargoes All documents related to the carriage of packaged dangerous goods shall

contain the Proper Shipping Name and the correct description shall be given in accordance with the classification provided for in the IMDG Code. Denomination of a dangerous cargo just by the trade name is not allowed.

g) Cargo Securing Manual In SOLAS vessels as defined in subparagraph h) of item 0102, the cargo, cargo

units and cargo transportation units shall be loaded, stowed and secured throughout the voyage in compliance with the approved Cargo Securing Manual, which shall meet at least the standard provided for in the guidance published by the IMO (MSC/Circ.745 or any other superseding it).

h) Chemical Product Safety Data Sheet - FISPQ (Material Safety Data Sheet - MSDS)

Ships carrying packaged dangerous goods shall hold, for each cargo type, a Chemical Product Safety Data Sheet – FISPQ (Material Safety Data Sheet - MSDS).

i) Carriage of dangerous goods considered as “harmful substances” The carriage of harmful substances shall comply with the provisions of Annex III

of the MARPOL 73/78 Convention, as amended, besides other applicable provisions set forth in this chapter.

j) Document of Compliance for the carriage of dangerous goods SOLAS vessels, as defined in subparagraph h) of item 0102, shall carry a

document of compliance for the transportation of dangerous goods, verifying that the vessel meets all special requirements for construction and equipment addressed in Regulation 19 of Chapter II-2 of the SOLAS-74 Convention, as amended, except for dangerous goods

class 6.2 and 7 and for the carriage of dangerous goods in limited quantities as provided for in Chapter 3.4 of the IMDG Code.

0105 - ADDITIONAL OPERATIONAL REQUIREMENTS

a) Access to the Vessel The access way to the vessel must be kept unblocked, either when anchored or

moored. b) Towing Facility

All vessels with dangerous cargo on board, either moored or anchored, shall be provided with towing cables of adequate dimensions at the bow and stern areas, ready for immediate use. Steps must also be taken to facilitate the quick release of mooring lines, without any help from land.

c) Signaling All vessels performing loading or unloading operations of flammable or explosive

products shall fly during daytime the BRAVO flag of the International Signaling Code, and at night, a circular red light with a minimum reach of 3 miles for vessels with GT higher than 50 and 2 miles for vessels with GT lower than or equal to 50.

d) Adverse Meteorological Conditions Moving of dangerous cargoes shall not be allowed when the weather conditions

imply an increase of risks to the goods themselves or to the packaging integrity, except in the case of previous analysis and authorization by the CP, DL or AG office.

e) Crew 1) Crewmembers responsible for loading and unloading operations of dangerous

cargoes, or those involved in their handling, have the deadline of April 30, 2014 for being qualified and certified through the Special Course of Operation with Dangerous Cargoes in the Waterways Work (EOCA), as provided for in Annex C of NORMAM-30/DPC.

Officers approved in the following courses, on or after the mentioned dates, are exempted from qualification through the EOCA course mentioned above:

- Adaptation Course for 2nd Deck Officer (ASON), beginning June/2011;

- Access Special Course for 2nd Deck Officer (CON-B), beginning April/2012; and - Training Course of Merchant Navy Deck Officers (FONT), beginning

January/2013. 2) Crewmembers responsible for loading and unloading operations of dangerous

cargoes, or those involved in their handling, shall undergo regular and periodical training by the companies responsible for the operation with dangerous cargo.

0106 - TECHNICAL REQUIREMENTS FOR PACKAGED DANGEROUS GOODS

This item highlights some technical requirements contained in the IMDG Code. Compliance with these requirements only is not sufficient, and does not exempt from meeting the full content of that Code.

a) Casing 1) The packagings or cargo units for the casing of dangerous goods shall be with

their integrity guaranteed, with no signs of violation of the closing or seal. Packages presenting signs of spillage shall be rejected.

2) The arrangements of packages or cargo units shall be done in such a way as to preserve the integrity and safety of the cargo and the people working or moving nearby.

3) The stacking height of packages shall not be higher than 3 m, except where devices are used which allow the reaching of a superior height without overloading the packages or compromising the safety.

4) The stowage of packages shall be made in such a way as to enable a marked and labeled face to stay visible in order to facilitate identification.

5) The closing of packages containing humidified or diluted substances shall be such that there will be no release of vapor and/or spillage.

6) The packagings shall meet all requirements described in the IMDG Code regarding types and limits, and shall be compatible with the enclosed product.

b) Packaging Groups The dangerous cargoes, excepting those of classes 1, 2, 6.2 and 7 are divided in

three groups according to the dangerousness of the enclosed product: - Group I - Cargoes of high dangerousness; - Group II - Cargoes of medium dangerousness; and - Group III - Cargoes of low dangerousness. This division influences all provisions regarding the construction and the proof of

reliability of the different types of standardized packaging or bottling and the enclosures which can be accepted for the transport

c) Approval for the Carriage of Dangerous Goods 1) The packagings, intermediate containers and tanks shall have been approved

by the Maritime Authority of the originating country, if the cargo comes from abroad. The Brazilian packagings shall have been approved by the DPC.

2) The shipowner shall present a copy of the approval certificate issued by the DPC, within validity, regarding the packaging or transport unit.

d) Package Marking Packages containing dangerous goods shall be marked in a durable way, able to

last for at least 3 months when immersed in water. They shall show the correct technical name (commercial names only are not acceptable), and also the corresponding UN number and the characters identifying the packaging’s approval in accordance with the IMDG Code.

The marking shall contain the United States (UN) symbol, followed by two lines containing codes.

1) The first line shall contain: I) The packaging type code according to the IMDG Code; II) The designation X, Y or Z, being:

-X for products of packaging groups I, II and III; -Y for products of packaging groups II and III; and - Z for products of packaging group III, followed by therelative density of the liquid used for testing, in the case of a packaging for liquids. This data may be omitted if the density is lower than 1.2. In the case of solids, the gross mass in kg shall be shown;

III) The letter S, when the packaging is tested for carrying solids, or the value of the hydraulic pressure in KPa rounded to the nearest multiple of 10 KPa, when the packaging is approved through this test; and

IV) The two digits of the packaging's manufacturing year. When the packaging is refurbished, the marking shall contain the letter R

and the refurbishing year.

2) The second line shall contain: I) The acronym of the country where the approval tests were conducted; II) The packaging manufacturer's acronym; and III) The code of the competent authority responsible for the approval, followed

by the number of the packaging's approval certificate. 3) Example of marking adopted in Brazil (figure 1.1):

This is the case of a cardboard drum (1G) intended for the carriage of dangerous goods of packaging groups II and III (Y), tested with a gross mass of 145 kg (145), for solid (S) cargo and manufactured in 1996 (96). Approved in Brazil (BR), manufactured by VAN LEER (VL), and approved by the DPC, with Approval Certificate No. 038/95 (DPC - 038/95).

4) The marking shall be made on at least two faces or sides of the packagings or cargo units.

e) Labeling 1) The labeling shall be made in conformity with the symbols standardized by the

United Nations, according to the IMDG Code. 2) If utilizing reusable plates for the identification of dangerous goods on cargo

or transport units, the plates shall have the backside in blank. f) Signaling

The storage places for flammable dangerous cargoes shall be signaled with posters determining the prohibition of smoking, and informing about the special precautions for handling the cargo and protecting human life.

h) Segregation The several classes and subclasses of dangerous cargoes that are incompatible

between each other shall be duly kept apart among themselves. Such a measure aims at avoiding interaction of contents in the case of an accidental spillage where, by reacting with each other, they might cause an even greater damage. The IMDG Code's segregation table shall be followed.

0107 - INFORMATION IN CASE OF INCIDENTS

If an incident occurs involving a loss, or probability of loss, to the sea of a dangerous cargo, such fact shall be immediately reported to the CP/DL/AG office of jurisdiction over the area where the incident has occurred, as well as, to other competent authorities according to the following situations:

- when dealing with a radioactive material, report to the CNEN and the environmental control body;

- when not dealing with a radioactive material, report only to the environmental control body.

The procedures to follow are provided for in the IMO Resolution A.851(20) - “Guidelines for reporting incidents involving dangerous goods, harmful substances and/or marine pollutants”, or any other that supersedes it.

0108 - FOREIGN-FLAGGED VESSELS a) Foreign-flagged vessels carrying packaged dangerous goods shall present the

following documentation: 1) Document of Compliance for carriage of dangerous goods, as provided for in

Chapter II-2 of the SOLAS 74 Convention, as amended, except for dangerous goods of classes 6.2 and 7 and for the carriage of dangerous goods in limited quantities as provided for in Chapter 3.4 of the IMDG Code;

2) Cargo Manifest or special list, as provided for in Chapter VII of the SOLAS 74 Convention and Annex III of the MARPOL 73/78 Convention, as amended. This document may be replaced by a detailed stowage plan;

3) Certificate or statement on the cargo to be shipped, as provided for in Chapter VII of the SOLAS 74 Convention and Annex III of the MARPOL 73/78 Convention, as amended; and

4) The documentation required in the Regulations for the Safe Carriage of Radioactive Materials, from the International Atomic Energy Agency. A CNEN representative shall analyze this documentation.

5) Ships carrying packaged dangerous goods shall hold, for each cargo type, a Material Safety Data Sheet - MSDS.

b) The documents listed in 1), 2), 3) and 5) above shall be checked, following the model forms provided for by the flag country's Maritime Authority.

c) The documents mentioned in 2) and 3) of subparagraph a) above, contained in the SOLAS 74 Convention and Annex III of the MARPOL 73/78 Convention, as amended, may be combined in a single document. In this case, clear distinction shall be made between the dangerous goods and the harmful substances (marine pollutants).

CHAPTER 2

TRANSPORTATION OF DANGEROUS SOLID CARGOES IN BULK 0201 - APPLICATION

This chapter applies to Brazilian- or foreign-flagged vessels, independently of their gross tonnage, as defined in Part A-1 of Chapter VII of the SOLAS-74 Convention, as amended.

0202 - REGULATIONS

The transportation of dangerous solid cargoes in bulk shall meet the following regulations:

a) International Maritime Solid Bulk Cargoes Code – IMSBC Code, as amended); b) Code of Practice for the Safe Loading and Unloading of

Bulk Carriers - BLU Code, as amended); c) International Convention for the Safety of Life at Sea - SOLAS 74, as amended;

and d) Medical First Aid Guide for Use in Accidents Involving Dangerous Goods -

MFAG, adopted by the IMO MSC/Circ.857 or any other superseding it. 0203 - DEFINITION

Dangerous solid bulk cargo means any material, other than a liquid or gas, consisting of a combination of particles, granules or any larger pieces of material, generally of uniform composition, fitting in the IMDG Code and that is loaded directly into the ship's cargo compartments without any type of conditioning method, including this type of material when loaded in a lighter or in a lighter carrier ship.

0204 - TRANSPORTATION OF RADIOACTIVE MATERIAL

The transportation of a solid radioactive material in bulk shall meet the following regulations, besides those described in item 0202:

- Radioactive Materials Transportation Standard, from the National Commission of Nuclear Energy CNEN - NE 5.01/88 and CNEN - 13/80.

0205 - DOCUMENTATION

In all documents related to the carriage of dangerous solid cargoes in bulk, the product's Bulk Cargo Shipping Name - BCSN shall be included. Using just the product's trade name is not allowed.

Each vessel carrying dangerous solid cargoes in bulk shall hold a list or Manifest, discriminating the dangerous cargoes on board and their respective locations. A detailed stowage plan identifying the cargoes by class and discriminating the location of all dangerous goods on board may be used in replacement to the list or Cargo Manifest. A copy of the document prepared shall be delivered to the CP/DLAG office of jurisdiction over the port, prior to the ship's departure. When dealing with a radioactive material, a copy shall also be given to the CNEN.

0206 - STOWAGE AND SEGREGATION Dangerous solid cargoes in bulk shall be loaded and stowed in a safe and proper

way, according to the cargo nature. Incompatible cargoes shall be segregated from each other. The applicable requirements of regulations referred to in items 0202 and 0204 shall be followed.

Dangerous solid cargoes in bulk, if subject to heating or spontaneous combustion, shall not be transported unless the necessary precautions are taken to minimize the possibility of a fire.

Cargoes that release dangerous vapors shall be stowed in a cargo compartment with adequate ventilation.

0207 - INFORMATION IN CASE OF INCIDENTS

If an incident occurs involving a loss or probability of loss to the sea of a dangerous solid bulk cargo, the procedures described in item 0107 of these Standards shall be followed.

CHAPTER 3

TRANSPORTATION OF NOXIOUS LIQUID SUBSTANCES IN BULK 0301 - APPLICATION

This chapter applies to chemical tankers of Brazilian or foreign flag, when carrying noxious liquid substances addressed in Chapter 17 of the International Bulk Chemical Code - IBC Code.

0302 - DEFINITIONS

For the exclusive effect of application of this chapter, the following definitions are here adopted:

a) International Bulk Chemical Code - IBC Code - means the International Code for the Construction and Equipment of Ships Carrying Dangerous Chemicals in Bulk, adopted by the IMO Maritime Safety Committee through Resolution MSC.4(48) and by the Marine Environment Protection Committee through Resolution MEPC.19(22), as amended.

b) Bulk Chemical Code - BCH Code - means the Code for the Construction and

Equipment of Ships Carrying Dangerous Chemicals in Bulk, adopted by the IMO Maritime Safety Committee through Resolution MSC.4(48) and by the Marine Environment Protection Committee through Resolution MEPC.20(22), as amended.

c) Noxious Liquid Substance - NLS - means any substance indicated in the

column Pollution Category of Chapter 17 or 18 of the IBC Code, or provisionally evaluated in accordance with the prescriptions of Regulation 6.3 of Annex II of the MARPOL 73/78 Convention, as fitting in Categories X, Y or Z.

d) Chemical Tanker - means a cargo ship built or adapted and used for the

carriage in bulk of any product listed in Chapter 17 of the IBC Code. e) Certificate of Fitness - means the Certificate addressed in Codes IBC or BCH. f) NLS Certificate - means the International Pollution Prevention Certificate for the

Carriage of Noxious Liquid Substances in Bulk, addressed in Annex II of the MARPOL 73/78 Convention, as amended.

0303 - REQUIREMENTS FOR THE CARRIAGE OF NOXIOUS LIQUID SUBSTANCES

Chemical tankers carrying noxious liquid substances mentioned in Chapter 17 of the IBC Code shall meet the requirements set forth in that Code or in the BCH Code according to their construction date, as prescribed in Regulation 11 of Chapter 4 of the MARPOL 73/78 Convention and Regulation 9 of Chapter 7 Part B of the SOLAS 74 Convention, as amended.

0304 - CERTIFICATION a) Chemical tankers carrying NLS of Code IBC Chapter 17 shall hold the Certificate

of Fitness prescribed in that Code or in the BCH Code, as applicable. When carrying only cargoes addressed in the IBC Code Chapter 18, chemical

tankers may operate with just the NLS Certificate provided for in Annex II of MARPOL 73/78, as amended.

b) Ships other than chemical tankers, when carrying NLS of Code IBC Chapter 18,

shall hold the NLS Certificate. c) Offshore support vessels, when carrying products of Appendix 1 of IMO

Resolution A.673(16) - “Guidelines for the Transport and Handling of Limited Amounts of Hazardous and Noxious Liquid Substances in Bulk on Offshore Support Vessels”, as amended, or other products duly authorized, shall hold the Certificate provided for in that Resolution's Appendix 2, a model of which can also be found in NORMAM-06.

0305 - INFORMATION IN CASE OF INCIDENTS

If an incident occurs involving a loss or probability of loss to the sea of a NLS, the procedures described in item 0107 of these Standards shall be followed.

TRANSPORTATION OF LIQUEFIED GASES IN BULK 0401 - DEFINITIONS

a) International Gas Carrier Code - IGC Code) - means the IMO International Code for the Construction and Equipment of Ships Carrying Liquefied Gases in Bulk, adopted by the Maritime Safety Committee through Resolution MSC.5(48).

b) Gas Carrier Code - GC Code - means the IMO Code for the Construction and

Equipment of Ships Carrying Liquefied Gases in Bulk), adopted through Resolution A.318(IX), as amended.

0402 - APPLICATION

This chapter applies to ships of Brazilian or foreign flag, when carrying liquefied gases in bulk.

0403 - REQUIREMENTS FOR THE CARRIAGE OF LIQUEFIED GASES IN BULK

Ships carrying liquefied gases in bulk, if built on or after July 01, 1986 shall meet the IGC Code requirements, while ships built prior to that date shall comply with the GC Code.

0404 - CERTIFICATION

Ships carrying liquefied gases in bulk shall hold the Certificate of Fitness provided for in the Codes IGC or GC, as applicable.

CHAPTER 5

TRANSPORTATION OF PACKAGED IRRADIATED NUCLEAR FUEL, PLUTONIUM AND RESIDUES OF HIGH RADIOACTIVITY LEVEL

0501 - DEFINITIONS

a) INF Code) - means the International Code for the Safe Carriage of Packaged Irradiated Nuclear Fuel, Plutonium and High Radioactivity Level Wastes on Board Ships, adopted by the IMO Maritime Safety Committee through Resolution MSC.88(71), as amended.

b) INF Cargo - means irradiated nuclear fuel, plutonium and high radioactivity level

wastes, transported as cargo according to class 7 of the IMDG Code. c) Irradiated nuclear fuel - means a material containing isotopes of uranium,

thorium and/or plutonium, which have been used to maintain a nuclear reaction of self-sustainable chain.

d) Plutonium - means a mix of isotopes resulting from this material, extracted from

an irradiated nuclear fuel in a reprocessing operation. e) High radioactivity level wastes - means the liquid residues resulting from the

operation of the extraction system's first stage, or concentrated residues from subsequent extraction stages, in a reprocessing facility for irradiated nuclear fuel, or solids which such liquid residues have been converted to.

0502 - APPLICATION

This chapter applies to vessels of Brazilian or foreign flag, independently of date built or size, including cargo ships with gross tonnage below 500, when carrying INF cargoes.

This chapter does not apply to warships, auxiliary warships or other ships owned or operated by a contracting government to the SOLAS 74 Convention and engaged solely in non-commercial, governmental service. However, such ships when carrying INF cargoes, shall act as far as practicable and reasonable, in a manner consistent with this chapter's provisions.

0503 - REQUIREMENTS FOR THE TRANSPORTATION OF INF CARGOES

A ship carrying an INF cargo shall meet the requirements of Code INF and CNEN Standard NE 5.01/88 and subsequent amendments, besides any other applicable requirements, and shall hold the respective Certificate required by that Code.

0504 - INFORMATION IN CASE OF INCIDENTS

If an incident occurs involving a loss or probability of loss to the sea of an INF cargo, the procedures described in item 0107 shall be followed.
