What Will You Look Like In Ten Years… …If You Never Exercise?
Most people don’t notice their bodies aging. One day they look down and think, “Whew! Where’d all this come from? My lack of energy is difficult enough to bear on its own, but now I also have all this extra mass!”
Each day we don’t exercise our bodies, they grow older and weaker, and our metabolisms slow down. Exercise is what keeps us feeling young, healthy, and energetic, thereby allowing us to accomplish what we must. This is why we are constantly being told to move our bodies and exercise.

In the last publication we discussed a man who had trained his parakeet to say "Shema Yisroel." One day the parakeet disappeared, and all of the owner's efforts to locate it were to no avail. A year after his parakeet had gone missing, the man heard the familiar call of "Shema Yisroel" coming from a nearby pet store. A conversation with the storeowner revealed that he had found the parakeet the very same day that it had flown away, in the afternoon. Was the storeowner obligated to return the bird to its original owner?
The Gemara (Chulin 139a) states that a chicken that was consecrated for the Bedek Habayis and then escaped from its owner does not retain its sanctity. The Rishonim (Tosafos, Ramban, Rashba, and others) explain that this is because a bird that escapes from its owner and leaves him no chance of finding it is considered Hefker and is no longer the property of the Beis Hamikdash. From this one can infer that if one finds a bird that has flown away from its owner he is not obligated to return it.
However, this holds true only if the bird's discovery took place following the knowledge of its loss by the owner. As soon as the owner realizes that the bird has flown away, Yi'ush takes place and the bird becomes ownerless, allowing the finder to keep it. But in the case mentioned above, the owner only noticed that the parakeet was missing in the evening (upon returning from work), while the bird was found by the storeowner beforehand–in the afternoon. This is a case of "Yi'ush Shelo Mi'daas"-Yi'ush that will take place upon the owner's realization of the loss, but which has not yet taken place at the time when the item was found. In such a case, the lost item cannot be kept by the finder but must be returned to its original owner (Shulchan Aruch Choshen Mishpat 262:3).
One question remains: Is the owner's claim that his parakeet had been trained to say "Shema Yisroel" considered to be a proper Siman? At first glance, it would appear that it is a proper Siman, for this is definitely a trait which is unique to this parakeet. However, the possibility exists that he had heard the call from outside the store and proceeded to fabricate a story in which he was the original owner. Hence the claim that he had lost a parakeet that cries "Shema Yisroel" is insufficient proof that the bird is indeed his.
To prove his claim, the man must bring two reliable witnesses–neighbors or the like–that can testify that one year before he had indeed lost a parakeet which was known for saying "Shema Yisroel." Alternatively, he could bring witnesses that could confirm that he had posted signs reporting the bird's disappearance. If the man would be able to provide such witnesses, the storeowner would be obligated to return his parakeet to him (see Shulchan Aruch ibid. 267:6).

מאז שהפסקתי למצוא זמן ללמוד תורה".

אחד יום ישראל". "שמע להגיד שלו התוכי שהרגיל מישהו פעם הי' התוכי נאבד, וכל המאמצים שלו למוצאו היו ללא תועלת. יום אחד, כעבור מחנות יוצא ישראל" "שמע הכרזת של המוכר קול האיש שמע שנה, סמוכה. שיחה עם בעל החנות גילה שהלה מצא את התוכי באותו יום שהוא נאבד. האם מחוייב בעל החנות להחזיר התוכי לבעליו הקודמים?
הגמרא בחולין )קלט, א( אומרת: "במקדיש תרנגולתו לבדק הבית ]ומרדה )=שברחה מבעלי'([ . . . כיון דמרדה פקעה קדושתייהו". ומסבירים הראשונים הטעם שאין באופן בעלי' מבית שברחה דתרנגולת ועוד(, רשב"א רמב"ן, תוספות, )ראה ואינה עוד ברשותו של בית המקדש. להבעלים אפשריות למוצאה נחשבת להפקר
מזה יכולים להסיק שהמוצא עוף שברח מבית בעליו אינו מחוייב להחזירו.אמנם, זהו אמת רק כשמציאת העוף קרה אחר שהבעלים הכירו שהעוף נאבד. מיד אותו המוצא ויכול הפקר, ונעשה ממנו התייאשו נאבד, שהעוף הכירו שהבעלים לקחתו לעצמו. אבל בנידון דידן, בעל התוכי הכיר שהתוכי נאבד רק כשחזר לביתו מהעבודה בשעות הערב, ואילו בעל החנות מצא התוכי לפנ"ז, בשעות הצהריים. מקרה זה הוא מקרה של "יאוש שלא מדעת", דאף שבודאי יתייאש כשיכיר בהאבידה, עדיין לא התייאש בפועל בשעת מציאת האבידה. ההלכה במקרה כזאת היא שהמוצא אסור
לקחתו לעצמו אלא צריך להחזיר האבידה לבעלי' )שו"ע חו"מ סי' רסב ס"ג(.נשאר לנו לברר האם קריאת "שמע ישראל" נחשבת לסימן מובהק. בהשקפה ראשונה הי' נראה שזהו כן סימן טוב, כי בודאי זהו דבר יחודי לתוכי זה. אבל לאידך, אין סימן זה מועיל, שאפשר שהאיש שמע הקריאה מחוץ לחנות, והמציא סיפור שהוא הבעלים הקודמים בכדי לזכות בהתוכי. מטעם זה אין טענתו )שלפני שנה אבד תוכי הקורא
"שמע ישראל"( כשלעצמה מספיקה לחייב בעל החנות להחזיר לו התוכי.בכדי להוכיח על אמיתית טענתו, על האיש להביא שני עדים כשרים--שכנים וכיו"ב--
שיעידו שלפני שנה נאבד מאתו תוכי שהי' ידוע בקריאת "שמע ישראל". כאפשריות שני', יכול להביא עדים שתלה מודעות אודות התעלמות התוכי. אם יכול להביא עדים
כאלו, מחוייב בעל החנות להחזיר לו התוכי )ראה שו"ע שם סי' רס"ז ס"ו(.)משפטי התורה על בבא מציעא סי' כג(
