No.RTR. lQP8/2223/C.R.265(Part-II)lDesk-II.-In exercise of the powersconferred by tllteproviso to article 309 of the Constitution of India and insupersession ofall the existing rules and orders issued in this behalf, andin force in the ~tate of any part thereof, the Governor of Maharashtra ishereby pleased to make the following rules for the Post RecruitmentTraining E~ination for the Assistant (Legal), in the Law and JudiciaryDepartment ~ the Government of Maharashtra, namely :-

1. Short titlf and commencement.-(I) These rules may be called theAssistant (~! ) post Recruitment Training Examination Rules, 2012,

(2) These les shall come into force on the date of publication in theOfficial Gazet .

2. Definitio~.-In these rules unless the context otherwise requires.­

(a) "Appendix" means an Appendix appended to these rules;

(b) "Assistant (Legal)"means a person appointed to the post ofAssistant(Legal) in Law tnd Judiciary Department ofGovernment ofMaharashtra ;

(c) "Commisrion" means the Maharashtra Public Service Commission;

(d) "Department" means the Law and Judiciary Department of theIGovernment; !,I

(e) "Examination" means the post Recruitment Training Examinationheld as per the Isyllabus prescribed under rule 10 read with Appendix 'A'to these rules;

(j) "Existing rules" means the rules and orders relating to the postRecruitment Training Examination for the post of Assistant (Legal), in

Law and Jud~ciary Department, in force immediately before thecommencement of these rules;

I

(g) "Government" means the Government ofMaharashtra.

3. Period and number of chances.-Subject to the provisions of theserules, every Assistant (Legal) shall be required to pass the Examinationwithin four years from the date ofhis appointment as an Assistant (Legal),

and within three chances.4. Period and number of chances for passing examination for persons

appointed prior to commencement of these rules.-Subject to the provisionsof these rules, every Assistant (Legal), who has been appointed prior to thecommencement of these rules and has not passed the eXaInination andshall be required to pass the Examination, has not been exempted frompassing the Examination as per rule 6 of the existing rules, within twochances and within a period of three years from the comrnencelnent ~,these rules including the chances he has already availed.

5. Consequence offailure to pass examination.- Any Assistant (Legal)who fails to pass the examination within the prescribed period and chancesallowed under rules 3 and 4 abovc-v-

(a) Shall not be confirmed in the post of the Assistant (Legal) till hepasses the examination or is exempted from passing the examination

under rule 6(2) and(b) Shall not be allowed to draw the next increment in the scale of

Assistant (Legal). The increments sowith held, shall become payable tohim with effect from the date on which he has passed the Examina+jonor exempted from passing the Examination under ru1e 6(2) and allfuture increments shall accrue to him as ifno increment was withheld,but he shall not be entitled to get any arrears during the period for'which the increment was so withheld, and

(c) Shall lose seniority in the cadre ofAssistant (Legal) and he shallrank below all the Assistants (Legal) who have passed the examinationbefore him and also below all those who are senior to such Assistai •(Legal) below whom he is placed, and who may pass the examinationafter him but within the period and chances specified in rules 3 and 4.6. Exem,ption from passing examination.-(1) An Assistant (Legal)

appointed before the commencement of these rules shall be exemptedfrom passing the examination, if-

(i) he is already confirmed as an Assistant (Legal); or(ii) he has already passed the examination under the existing

rules; or

(iii) he has already been exempted from passing the examinationunder the existing rules.

(2) On or!after the commencement of these rules, if the Assistant(Legal), attalins the age of forty-five years, he shall be exempted frompassing the ~xamination. But he shall not regain the seniority, whichhe has alreadv lost as per the rule 5(c).

7. ExamintLtionwhen tobe held.-Ordinarily, the examination shall beheld by the Geperal Administration Department of the Government oncein a year either in the month of August or September. The examinationshall be conducted either in Marathi or English or in both the languages.

8. Conseql.fenceswhen examination not held.-If for any reason, theexaminati- if.not held in any particular year, that year shall beexcludedin computing ~he period specified under rul~ 3 and, 4.

9. Number of chances for appearing for examination.-Subject toprovisions of~es 5, Assistant (Legal) may avail ofany number of chancesfor appearing for examination.

10. Syl~us.-The Syllabus and number ofmarks for the examinationshall be as shpwn in Appendix-~ and any subject as the Govemment maydirect from ttme to time, by an order.

11. Stanfard for passing .-The Standard for passing the examinationshall be forty per cent of the total marks in each paper.

12. Exemptions in subjects.-An unsuccessful candidate in anyexaminatio~ who has secured fifty per cent marks or more in any paper,shall be exempted from appearing and passing again in that paper in his

subsequent ?ttempts.I13. Special Merit.-Whereas an Assistant (Legal) passes the

examinatioIlt in the first attempt and secures seventy per cent or moremarks in rujrypaper, an entry regarding his special merit in that papershall be recbrded in his Confidential Report.

14. Training class.-(1) A training class for imparting training tocandidates who desire to appear for the examination shall be conducted bythe Gov~rnlment as per details shown in Appendix 'B' at least one monthbefore the ~ate of holding of the examination.

(2) Attendance in the trainig class is optional and not compulsory.

(3) AnAssistant (Legal) may avail the facility of the training Classonlyonce. He shall apply for training and for admission to the said examinationin writing in the form prescribed in Appendix 'C', before the LstMay of theyear during which he desires to avail the facility of training class and foradmission to the examination. The application shall be addressed to theSecretary to Government, General Administration Department,Mantralaya, Mumbai and he shall arrange to inform the candidates whetherthey have been admitted to (a) the training class and (b) the examinationspecified in the application,

(4) The General Administration Department of the Government may timpart training to the Assistant (Legal) in the post recruitment trainingclasses conducted by it for Non-Legal Assistants. Where a person isadmitted to the training class, the Department shall give him the necessaryfacility for attending the class.
