    Community Rules and Regulations

    WHEREAS, the Board of Directors of the 530 Lake Shore Drive CondominiumAssociation is empowered to adopt rules and regulations governing the Residential Unitsand the Common Area pursuant to the Declaration of Covenants, Conditions andRestrictions and of the By-Laws.

    WHEREAS, there is a need to adopt and periodically update a set of rules to clariS' andcommunicate the mutual considerations and concerns that are an integral part of residingin our community.

    WHEREAS, it is the intent that these rules are applicable to all owners, tenants, guests,invitees, or any others who occupy or use the common areas and this resolution shallremain in effect until otherwise rescinded, modified, or amended by a majority of theBoard of Directors.

    NOW THERBFORE, BE IT RESOLVED THAT the following rules are adopted

    Introduction

    The quality of life in a common interest community depends in large part on howresidents conduct themselves. Our Declaration of Condominium Ownership subjects allhomeowners to general covenants, while the By-Laws and Rules and Regulations providespecific guides for day to day living. Without these restrictions, and a means to enforcethem, the community living experience would be less orderly and predictable. YourBoard of Directors has adopted the following rules and regulations to help insure that thecommunity will always be an attractive, highly valued, safe, harmonious and desirableplace to live.

    These Rules and Regulations do not supersede or change the

    Declaration or By-Laws in any manner. They are, however, equallyenforceable under the law. Although certain privileges and obligationsinure only to unit owners, the Rules and Regulations apply to allowners, tenants, occupants, guests and service providers.

    Bike Room Storage/Bicycles Page 26. Item #1. There was a misprint and should read:

    1. The bike rooms are located on the east and west end of the second floorparking garage. All bikes will be assigned a location (East Bike Storage orWest Bike Storage). All bikes will be assigned a space and must beregistered with the Management Office. A registration decal will be issuedand must be affixed to the bicycle as valid identification. There is a two (2)person bike unit policy. Only bicycles can be stored in the bike room. Ownersare responsible for providing security locks for bicycles. Bicycles may also bestored inside the unit owner or resident's storage locker or unit. Managementhas the right to remove any unidentified bicycle from the bike room. Bicyclespace does not transfer with the sale or lease of a unit.

    The general rules of The 530 Lake Shore Drive Condominiums Association are asfollows:

    Advertisin g/Solicitation s

    Notices, signs or advertisements may not be posted in any common or limitedcommon area of the building,Canvassing or distributing material to individual units is limited to officialbusiness of the Association and Management.Door-to-door solicitation is prohibited.These restrictions do not apply to residents who wish to distribute campaignliterature or knock on their neighbors' doors for the purpose of politicalcampaigning.

    Assessments and Other Charges

    L All monthly assessments and any special assessments or other lawful charges,without limitation, of the Association are due and payable on or before the I'tday of each month and considered late after the 15ft day of the month. Monthlystatements are a courtesy, and assessments and other charges are due regardless ofwhether a statement is received.All charges authorized by these rules will be charged to the unit owner.Unit owners are responsible for any and all unpaid service charges created bytheir lessees. Unit owners must either contact the Management Office directlyto request maintenance service or must provide written notice authorizing lessees

    to initiate non-emergency maintenance requests from Association employees forwhich there is a charge. Damage charges, fines or other expenses resulting from alessee's activities will be charged to the unit owner's account (see Fine Schedule).A late payment charge (see Fee Schedule)will be assessed against unit ownerswhose assessment account balances (inclusive of all regular assessments, specialassessments, ftnes, service charges, work order charges, etc.)are not paid in full by the 15ft of the month. The late charge is subject to changefrom time to time by order of the Board.Payments for assessments must be made by mail or through the automaticpayment plan (SNAPP) available through the Sudler Management Company. Asan exception, payments will be accepted only up to and including the first day ofthe month at the Management Office.Payment for assessments and other charges may only be made by check or directdebit. The Association charges unit owners and residents whose checks arereturned NSF an additional service fee (see Fee Schedule) plus the prevailingbank service charges. The amount of the returned check service charge is subjectto change from time to time by order of the Board.

    When any portion of the unit owner's account becomes forty-five (45) days pastdue, the account shall be forwarded to an attorney to initiate legal proceedings

    including but not limited to the filing of a lien to collect all sums due and owingto the Association (see Fine Schedule).After a notice of default has been mailed to the unit owner, the Board may, in caseof continuing deficiency, impose a property lien or take other appropriate legalaction.All attorney's fees and court costs charged to the Association for the collectionof a unit owner's account shall be paid by the delinquent unit owner and shall beadded to and deemed part of the unit owner's monthly assessment and the accountto be collected.

    Balconies

    Propane tank grills prohibited, per City of Chicago Code.Nothing shall hang or be affixed on the outside of the balcony railing.Nothing is to be thrown or positioned so as to fall from a balcony or terrace.No activity is to take place on balconies or terraces which may disturb buildingresidents.Care should be taken while watering plants and cleaning the balcony floor sowater does not drip down to balconies or terraces below.

    Bike Room Storage/Bicycles

    The bike rooms are located on the second and third floors of the parking garage.All bikes will be assigned a space and must be registered with the managementoffice. A registration decal will be issued and must be affixed to the bicycle asvalid identification. There is a two (2) bike per unit policy. Only bicycles can bestored in the bike room. Owners are responsible for providing security locks forbicycles. Bicycles may also be stored inside the unit owner or resident's storagelocker or unit. Management has the right to remove any unidentified bicycle fromthe bike room. Bicycle space does not transfer with the sale or lease of a unit.Bicycles are not allowed in the lobby areas. Bike owners may, however, utilizethe service elevator and corridors for the transfer of bikes to and from storageareas and residential units. Bicycles may enter or leave the building only through

    the garage or loading dock.The Association, Board, Managing Agent, and Association employees disclaimany responsibility for any loss or damage to bicycles on Association property.

    Unit owners and residents are responsible for any damage to common elementscaused by their bicycles. Unit owners and residents are responsible for damagecaused by their guests' bicycles.

    Bulletin Boards

    1. All public bulletin boards are locked. Use of the bulletin boards is limited to unitowners and residents.

    2. Residents must obtain Management approval for the posting of advertisementsand/or announcements on all common element bulletin boards located in thebuilding.

    3. Postings are permitted for no more than a four week period or upon expiration ofthe content of the posting, whichever comes first.

    4. Management will not approve of the following type of postings:a. Condo rental notices.b. Sales listings of residential units in other condominium buildings.

    6. Posting must be produced by the individual requesting approval and posting mustbe on a 3x5 index card

    7. The bulletin board in the mailroom is reserved for Association use only.

    Business Center/Conference Room

    The Business Center is located on the first floor at the east end of the building. TheConference Room is available to host any meeting you may want to conduct from yourhome. There are three offices, each equipped with a modem and high-speed internetconnection. Also available is a printer, fax, and a copier as well as a meeting table andchairs. The Management Office must be contacted for reserving the use of this facility.

    Car Wash

    The building provides a self-serve car wash bay which is located inside the entrance ofthe garage. One hour/per car reservations are to be made at the front desk with the doorstaff. The building provides a hose with a adjustable spray nozzle and a wet vac.

    The Community Center

    1. The Community Center is located on the 8ft floor and has the capacity to serve100 people.

    2. Reservations are required for the room's exclusive use and are taken on afirst-come, first-serve basis. Reservation forms are required and are availablefrom the management office. This request must be submitted at least twoweeks, but no more than one year prior to the desired date. A resident may notbook the room for the same date or holiday two years in a row, unless six (6)months prior to the planned event, and no one else has requested the date.

    3. The unit owner submitting the reservation request must be present at all timesat the event for which the room is reserved. The reservation form is to beaccompanied by a refundable damage deposit (see Fee Schedule). The Boardof Directors shall set all fees, fines, and deposits on an annual basis.

    4. The Community Center events may be held between 10:00 a.m. and 11:00p.m. Sunday thru Thursday and between 10:00 a.m. and 2:00 a.m. on Fridayand Saturday, and on days proceeding a national holiday and holidays notfollowed by a workday. A complete list of nonresident guests must befurnished Management at least three days prior to the date of the event. Thelobby staff will not admit nonresident guests who have not been included onthe list.

    5. A list of catering, party rental, entertainment or other firms servicing the eventmust also be provided to management three (3) days prior to the event. Also,proof of general liability insurance with the Association named as additionalnamed insured must be provided at that time.

    6. Service providers must park any vehicles in the areas designated bymanagement and will be subject to applicable guest parking fees. Serviceproviders will be subject to the Rules and Regulations of the CondominiumAssociation with regards to parking violations.

    7. Smoking is prohibited in the Community Center.8. Guests are restricted to the Community Center only.9. The Community Center is intended for the private social use of the 530 Lake

    Shore Drive residents only, and not for commercial functions. No fee may becharged to guests for admission, attendance, food or drinks.

    10. Live, recorded music, or entertainment is permitted only with prior writtenpermission of management at the direction of the Board of Directors. Inall cases, care must be taken not to disturb other residents. In no event shallthere be amplification that is offensive to any resident.

    I 1. Management and its representative have the right to require that the noiselevel of activity be reduced, if there are complaints that the event is too loud(see Fine Schedule).

    12. The room has been designed for residents' adult and family activities. Anyevent whose attendees will include persons under the age of 21, shall haveOne (1) adult present for every eight (8) minors in attendance.

    13. If alcohol is served, the resident hosting the party is responsible to see that nominors are served any alcoholic beverages. Use of the Community Centermust not violate any state, federal, or local laws (see Fine Schedule).

    14. The resident must leave the Community Center as clean as they found itimmediately after use, and must leave all garbage in tied plastic bags.

    Common Elements

    Loitering is prohibited in all conrmon elements.Smoking is prohibited in all common elements of the property, including theFitness Center, the Community Center, the Dog Run Area, and the Sundeck.Playing or running is prohibited in any common elements.Common element doors must not be propped open or the locking mechanismtampered with in any way.City of Chicago Fire Department regulations prohibit placement of any personalproperty , including doormats, rugs, shoes, etc., in hallways, stairwells or outsideof locked storage cages in storage areas. Association employees are authorized toremove any such articles without notice.Unit owners or residents shall not paint, decorate, adorn or place signs upon theoutside of a unit, including the door to the unit. The thresholds to unit doors mustcomply with the building standards.The owner may attach traditional winter holiday decorations to the unit door fromthe third Wednesday in November thru January 7s. Any decoration applied to theunit door must comply with the City of Chicago Fire Code by neither supportingcombustion nor carrying a flame when subjected to a temperature of 1,200degtees Fahrenheit. Acceptable decorations include those made entirely of metalor asbestos or 100 percent spun glass fibers of metal and asbestos with allattachments, supports, and framing of metal; or must meet the requirement of thesmall scale tests given in the National Fire Protection Association's Pamphlet No.701 entitled Standard Methods of Fire Tests for Flame Resistant Textiles andFilms, 1973 Edition, and be so certified by a testing agency recognized by thebureau of fire prevention.Decorations may not impede or obstruct visibility of the unit number on the door.A unit owner or resident must have the specific written permission of the Boardbefore making any alteration to a common element.

    Cooking devices may not be used in any common element other than theCommunity Center and Sundeck kitchen without Board approval.Any owner, resident or guest may not use the common elements for commercialpurpose.

    Deliveries/Service Access

    l. The Management office will oversee entry authorization to resident units duringnormal business hours, when written authoization is provided.2. Residents may leave duplicate keys with the Management Office only for releaseto delivery persons, maids, contractors, service technicians or other personsauthorized to enter a resident's unit.

    3. Unless the resident has filed a written "Permission To Entero'form with theManagement Office, no one will be provided with a key to a unit. Managementhas the right to ask to see photo identification of the resident when Permission toEnter form is accepted.

    4. During normal business hours, Management will provide a duplicate unit key to aguest if the resident provides the Management Office with a fax or written memosigned by the resident, accompanied with a copy of the resident's photo

    identification. Sufficient notice must be provided during regular business hours toensure provision of a unit key to a guest under these circumstances. Telephonecalls are not sufficient to allow entry. Permission to Enter requests must be inwriting.

    5. The person to whom a duplicate key is issued must sign it out and back in. Aguest when checking out a resident's unit key must leave either a stateidentification card or a Driver's license as security.

    6. Unit owners or residents who have authoized an individual(s) to have permanententry to their unit may provide that person(s) with keys to enter the unit. Withoutkeys, access to guests will be granted during normal business hours through theManagement Office.

    Grocery deliveries must be brought through the loading dock.The Association is not responsible for perishable items delivered to the building.Furniture or other large items scheduled for delivery or moves must be broughtthrough the loading dock. Residents must arrange for such deliveries or moveswith the Management Office during normal business hours to schedule space atthe loading dock and use of the designated freight elevator.Association employees are prohibited from accepting cash or C.O.D. deliveries.A11 deliveries including package delivery services such as Federal Express andUPS must be brought to the Receiving Room. If Receiving Room is closed thedoor staff person will call the resident. If the resident is not home to accept thedelivery, the Door Staff will refuse it with the exception of an express envelope or

    prescription medicine. Resident will be called and a message will be left onanswering machine. Delivery will be kept at front desk for later pick up.Association employees will not accompany any person, including serviceor delivery persons, to a unit or sign for a delivery to a unit.Delivery or service personnel will not be provided with a duplicate key to a unitif the unit owner or resident is not present unless a prior written Permissionto Enter form is signed by the unit owner or resident is on file with theManagement Office.

    DisturbanceslRule Violations

    1. Resident shall not permit or participate in activities in the units or corrrmonelements that will unreasonably disturb or interfere with the rights and comfort ofother unit owners or residents.

    2. Musical instruments may be played in the units only between the hours of 9:00a.m. and 9:00 p.m. provided the sound does not unreasonably disturb otherresidents.

    3. If a resident has a complaint about noise or another violation from anotherresident, the complainant should notif,' the Management Office at the time whennoises are heard. If the disturbance occurs after Management Office hours, thecomplaining resident should contact the door staff so that maintenance staff mayinvestigate the complaint and document its findings.

    4. Complaining residents should complete a written complaint form with theManagement Office to support a disturbance or rules violation complaint.

    5. Management has the authority to request access to a unit to investigate a noise orrules violation complaint.

    6. All Residents must comply with a request by Association employees to cease thedisturbance or rules violation.

    7. In the case of such disfurbances or violations, Management or Associationemployees will notiff the resident of the complaint. A resident will be given anopportunity to correct the problem. If the disturbance or rules violation continuesunabated thereafter, it shall be declared a nuisance, and thus, a violation of thisrule and subject to enforcement procedures and fines (see Fine Schedule) throughthe Board.

    8. To report outside disturbances that occur within the vicinity of the building,residents should contact the Management Offrce, the Alderman, or the PoliceDepartment.

    Door Staff

    L The Door Staff are a vital part of the building's security system. They areemployed only secondarily for the convenience of residents and their guests. TheDoor Staff will provide access only to residents and those guests whoseadmittance has been authorized by a resident via use of a Permission to Enterform, memo, fax, or inclusion of their name with the Management Officeadmittance list. The Door Staff is instructed to request identification to ensureproper admittance from any resident or guest unknown to them.

    Z. Residents or guests may not ask the Door Staff to:o Leave the front of the building in search of a taxi. The cab light alert is tobe used to signal taxi.

    o Transport luggage or packages to or from a resident's unit or performother personal services that require the Door Staff to leave the general areaof their responsibility while on duty.

    o Allow use of the Door Staff station telephone to make or receive atelephone call.

    o Pass a guest through to a unit without obtaining prior permission bytelephone of the resident.

    o Allow reference to any resident information.o Permit a delivery person to enter the building or permit use of the luggage

    carts unless the Sign-in /out sheet is used.o Accept keys or key access tags to any unit.

    3. The Door Staff have been instructed to notiff the Management Office of residentswho break the rules related to either the Door Staff function or use of the lobby.

    4. The Association, Board, Management Company, and the Association employeesdisclaim any and all liability resulting from items left at the Door Staff station.

    5.The Door Staff will also be scheduling and monitoring the guest parking spaces,the transport carts, and the self-serve car wash'

    6. The Door Staff will accept express mail envelope and medical prescriptiondeliveries only when the Management Office and Receiving Room is closed'

    Drains

    Caustic chemical drain openers, such as Drano or Liquid Plumber, must not be used tounplug clogged drains. In the event of clogging or slow drainage, contact theManagement Office immediately. There is no charge to clean out a drain.

    Drivewaylloading Dock

    l. The entrance driveway of the building is intended for loading and unloadingpassengers or hand luggage. Vehicles may not be left unattended in the driveway.Such vehicles are subject to being towed without notice to the vehicle owner.

    2. The loading dock is for the exclusive purpose of moving, and loading/unloading ofvehicles Parking is prohibited at anytime. Vehicles may not be left unattended inthe loading dock area at any time without the specific permission of theManagement Office.

    Elevators

    l. City of Chicago Ordinance prohibits smoking or the carrying of lighted smokingmaterials in the elevators.

    2. Drinking or eating is not allowed in the elevators.3. Residents are responsible for clean-up of any "accidents" on the elevator due topets.9. Only Management may post signs, posters, ads and notices on the elevators.10. Vandalism or other damage to the elevators is an offense chargeable to the

    responsible unit owner.I 1. Trades people and delivery persons must use the designated service elevator.

    Deliveries must be scheduled with the Management Office.12. Residents using elevator to the sun deck for sun-bathing must wear proper cover-

    up over their swimsuits.13. Owners moving in or out of the building must make prior arrangements with the

    Management Office for use of the designated service elevator.

    14. Please refer to the " Moving" section of the Community Rules and Regulations.15. No one shall unnecessarily hold or otherwise interfere with the normal operationof the elevators. The elevators are reserved for the exclusive and unintemrpteduse of residents and other persons lawfully on the property.

    16. In case of fire, residents must use the stainvays, not the elevators.

    10. For health reasons, please wipe off equipment after use.1 1. Residents must place fitness room waiver on file with management prior to

    using the room.12. Fitness room privileges may be revoked if rules are not properly followed.13. Exercise equipment must not be removed from the Fitness Center.14. Fitness Center users are encouraged to report violations of these rules to the

    Management Office.

    Garbage/Chute Room

    1. The garbage/chute room is located on each residential floor at the door west of thewest exit stairwell. The trash chute opening is 14 inches tall and 13 inches wide.

    2. All items must be securely bagged and tied. Properly secured garbage must bepushed completely down the

    garbagechute before closing the chute door.3. The Association encourages recycling and recommends the use of the City of

    Chicago Blue Bag program. The Management Office has information about thisRecycling program. Blue bags must be thrown down the garbage chute.

    4. Diapers and animal litter must be double-bagged before they are thrown down thegarbage chute.

    5. No construction debris shall be thrown down the garbage chute.6. Explosive, flammable, or other hazardous materials, such as matches, lit

    cigarettes, etc., must not be thrown down the garbage chute. These items must bedisposed of at the freight holding arealloading dock.

    7. Popcorn and other styrofoam packaging material must be bagged and tied beforebeing discarded.

    8. "Bulk" or "special" pick up materials are the only permitted exception to therequirement for the use of approved containers. There will be a bulk pick-up fee.

    9. No garbage, trash or recyclable items may be placed outside of the unit.10. All trash, garbage, and recyclable items shall be promptly removed from any

    portion of a unit and not be allowed to accumulate.I l All contractors and service providers must make their own arrangements for

    timely removal of all debris generated by their work.12. Unit owners or residents are responsible for the removal of their moving and

    packing boxes and materials from the common elements.13. Bubble wrap, packing popcorn, and paper should be wrapped in a plastic bag,

    tied, and thrown down the garbage chute. Cardboard boxes (all sizes) for movingshould be broken down and placed in the dumpster located in the mezzaninefreight holding area.

    14. Large items that are too large to fit in the garbage chute such as extra-largemoving boxes, appliances, carpeting remnants, and construction debris willrequire a Special Bulk Pickup. Such pickups are scheduled by the management

    office and a fee is charged according to bulk. Management will provide atthattime the designated pick up area.15. Items should not be abandoned in the garage area or the loading dock area.

    Owners abusing this rule will be charged the service fee billed to the Associationby the scavenger service. Garbage disposal is restricted to the hours of 7:00 a.m.thru l0:00 p.m.

    Guest Parking

    Eight (8) guest parking spaces are available. This is a self-park facility. The Door Staffare not allowed to leave their station to park a car. The Door Staff must be called by the

    owner for reservations. The guest will be given an assigned parking space and a reservedparking tag to place on the rear view mirror. The guest parking hourly fees will begin atrequested reservation time and will continue until the parking tag is returned to the doorstaff station. At that time, the guest will be logged off the book. The unit owner's guestparking fees will be included in the monthly assessment bill. Cash, check, charge card,etc. is never accepted for this service. Guest parking fees may be changed by the Board.The Association, the Management Agent and the Management Staff assume no liabilityfor any damage or theft of cars parked in the guest parking spaces.

    Housekeeping

    1. Nothing may be swept, shaken or thrown out of the windows, balconies, terracesor doors, or cornmon area halls, stairwells, or elevators.

    2. Spills or other mishaps in the common elements, including elevators, should bereported immediately to the Management Office or the Door Staff.

    HVAC/Fan Coil Maintenance

    Twice yearly, the fan coil units require maintenance. In the fall, the unit will be openedand the filter will be replaced. In the spring, the unit will be vacuumed, the coil will becleaned, the condensate pan will be flushed and checked for proper drainage, and thefilter will be changed. This is a building service. Owners will be provided a writtennotice of scheduling of times and dates. These fan coil units must be unobstructed forproper airflow and accessibility for maintenance and repairs. If the unit owner prefersadditional filter change(s) or cleaning(s) they may call the Management Office for aservice appointment. Please refer to the Fee Schedule for appropriate charge(s).

    Insurance

    Although the Association is required to maintain specific insurance coverage, thiscoverage does not cover the personal property of the unit owners or residents, includingthe contents of individual units, the contents of storage lockers, and bicycles stored in thebicycle rooms, automobiles parked in the garage, nor does it cover accidents occurringwithin individual units. For these reasons, residents and unit owners are responsible forobtaining their own insurance on the contents of their units and the limited commonelements serving those units, as well as any additions and improvements, decorating,furnishings and personal property in the units, and personal property stored elsewhere onthe property. It is recommended that you also carry personal excess umbrella liabilityinsurance. Unit owners wishing to coordinate their homeowner's insurance policy with

    the policy covering the Association should contact the Management Office.

    Keys, Lockouts

    Residents should never leave their unit doors open or unlocked.Association employees, including Door Staff, will not accept keys.Each unit owner must provide the Management Office with a current set of unitkeys for all locks on each unit entry door. This is necessary for emergency accessto a unit in the event of fire or flood, for servicing, and to assist with a lockout. Ifthe unit owner refuses to provide the Management Office with a key, a Release ofLiability form must be signed by the Owner(s). In the event a forced entry isrequired during an emergency, the unit owner, not the Association, theManagement Company, nor the Building Staff will bear the expense of lockreplacement, damage to the door, or any and all damage incurred in the buildingdue to emergency.

    4. During regular business hours, residents may sign out and return duplicate key forany reason, including a lockout, at the Management Office at no charge.

If residentdecides to call another service or receives a duplicate key from a family memberor neighbor, etc. the lock out fee will still be executed due to a call requestingretrieval of the Building Engineer to the building.Identification may be requested when a key is provided to residents who arelocked out of their units.Unit owners installing private alarm systems for their units must notiftManagement prior to installation. Residents must register the alarm monitoringcompany's name and phone number with the Management Office to allow entryin case of an emergency. Individual security systems that are disruptive to otherresidents are not permitted. Unit owners are responsible for any costs incurred inremoving such systems or modiffing them in order to eliminate any disruption.All residents are encourage to provide the Management Office with duplicatekeys for release to a delivery person, maid, contractor, service technician, orother person with a written "Permission to Enter" form.Please refer to the section on Deliveries/Service Access for information regardingprocedures for access to a unit by guests, delivery persons, maids, outside servicetechnicians, contractors, or any other person authorized to enter a resident's unit.

    Mailboxes

    The Mail Boxes are located off of the lobby area; each resident has their own key. Pleasedirect miss delivered mail to the drop box. Management will not accept mail from thebuilding's mail carrier for storage while a resident is out of town. Arrangements must bemade with the Post Office to temporarily stop delivery or make other arrangements withthe building's mail carrier to hold the mail. Association employees, including Door Staff,are not allowed to accept or hold mail for a resident.

    Maintenance

    l. As stated in the Condominium Declaration paragraph 15 (a) each unit owner, athis own expense, shall furnish and be responsible for all maintenance of, repairsto and replacements within his unit. Maintenance of, repairs to and replacementswithin the common elements shall be the responsibility of, and shall be furnishedby, the Association. Maintenance requests should be referred to the ManagementOffice or to the Door Staff on duty. With the exception of emergencies, workorders are performed during the hours of 9A.M.through 3:30 P.M. Mondaythrough Friday. Emergencies include uncontrolled running water, fire, windowbreakage, or any other condition that could cause injury or property damage.Non-emergency work requests will not be accepted from a tenant unless the unitowner has given authorization allowing the request.

    2. All maintenance requests are scheduled by the Management Offrce and/orEngineer. Please also refer to the Owners Warranty Manual of this Handbook.Employees will repair standard building plumbing fixtures if parts are available,unclog drains, repair or replace broken pipes (those which are not part of thecommon elements) and repair or replace electrical outlets, switches and lightingftxtures, including changing light bulbs, fluorescent tubes, starters and ballast.The Association assumes no liability for accidents in the units. Unitowners should be aware of their responsibility and check their insurance policiesfor coverage.

    3. Labor costs will be billed at the prevailing rates. Parts and materials will be billedat the actual purchase price including sales tax. Labor costs and parts are subjectto change. The charges will appear on the monthly assessment statement. (See FeeSchedule Section of Handbook)

    Management

    t. All matters conceming the units or inquiries to the Board of Directors should bedirected to the Management Office. Correspondence addressed to the Board as"Board only" or "personal" or "confidential" should be placed in a sealed.envelope to ensure that it will be delivered directly to the Board and not openedby Management. A drop box will be provided for written correspondence.

    2. Employees of the 530 Lake Shore Drive Condominium Association are under thesupervision of the Building Manager and the Managing Agent. Suggestions or

    comments regarding the performance of any employee should be made directly tothe Management Office.3. No one except the Management Office or persons authorized by Management

    may give the 530 Lake Shore Drive Condominium Association employees workorders or verbal instructions.

    4. The Management Office hours are Monday thru Friday, 9:00 a.m. to 5:00 p.m.

    Move In and Move Out

    1. No residenVunit owners moving in or out will be allowed to do so without priorwritten authorization from building management.

    2. Moves are to be scheduled in four-hour blocks from 7:00 a.m. to 11:00 a.m. and12:00 p.m. to 4:00 p.m. Monday thru Saturday. Moves are not allowed to startafter 3:00 P.M. Sundays and holidays are prohibited. Moving days and times aresubject to change .

    3. Scheduling of move with Management Offrce must take place within 15days prior to move. Scheduling is based on a first come/first serve rule.

    4. Moves will not be permitted unless the Management Office schedules them.The maintenance staff will prevent movers from using the designated service

    elevatorif

    the above rules have not been met. The Association will impose anadditional nonrefundable penalty, in an amount set by the Board, to the unitowner who violates any of these move-in or move-out rules.

    5. A moving security deposit (see Fee Schedule) made payable to "The 530 LakeShore Drive Condominium Association" shall be left with the Management Officeat the time of scheduling. Immediately prior to moving, an Association employeewill check for any damage to the designated service elevator or other coillmonelements before and after the move is complete. Moves that are in progress after4:00 p.m. will result in a fee (see Fee Schedule) until the move is complete. Aftercompletion of the move, the time-use overage will be calculated, and damageswill be checked in elevator and common elements will be evaluated andcalculated. The deposit amount will be revised if needed, processed and refundedto the owner. The deposit amount will be revised if needed, processed andrefunded to the owner.

    6. All moving shall be conducted through the loading dock. No moving of any kindwill be permitted through the lobby or take place on the passenger elevator.

    7. Residents will need to make special arrangements with the elevator maintenancecompany to open the elevator cab roof if they have an item too large to fitsafely within the elevator. The service elevator height is 9'7", the side to sidedimension is 6'8", front to back is 4' x9' , and both doors are 42" wide and 7'tall.The weight capacity is 2,500 pounds. The elevator company charges for twomechanics to place furniture on top of the elevator and take to the proper floor.

    The labor will be charged at$239.24 per regular mechanic hour. Should yourequire service during overtime hours the premium per hour rate to be added tothe $239.24 per hour regular time rate is $178.30. This would bring the totalovertime billing rate to $417.54 per hour. These rates are subject to change bythe elevator maintenance firm without notice.

    8. Owners/residents may not move into any unit until the Management Off,rce hasbeen supplied the appropriate documents including, but not limited to, a copy ofHUD closing statement, resident information form, move-in security deposit, a

    written confirmation of move-in date and time from management, a signedauthorization of receipt of the Owners Handbook and Move-In Procedures, and aunit key copy or assigned release of key liability form.

    9. It is the unit owners responsibility to make sure the movers provide a protectivecovering on common element carpeting that does not interfere with access.

    8. The Association assumes no liability or delays ensuing from unanticipatedelevator repairs or malfunctions. The Board has authorized the management agentto stop any move in progress if rules, obligations or procedures set forth have notbeen adhered to. It is further understood that failure to follow said procedures, etc.may result in the association assessing a fine or the forfeiture of the securitymoving deposit.

    Parking/Vehicles

    L All vehicle drivers are required to observe and comply with all speed limits, aswell as "STOP", "NO PARKING", and "YIELD" signs throughout the propertyincluding the garage.

    2. Contractors or any other service providers are not allowed to park in buildingunless if allowed in writing to park in owner's parking space

    3. Vehicles parked in violation of the rules and regulations are subject to towing atthe resident's expense. Unpaid towing and storage charges shall be added to themonthly assessment of the homeowner who approved entry of the vehicle.

    4. Residents are requested to register with the management office the make, model,and license number of vehicles regularly kept in the garage to facilitateidentification and enforcement of the rules governing parking.

    5. All residents must park in their assigned space.5. Guest parking is available and located on the first floor, lobby level.

    Occupancy of Units

    No Unit may be occupied by anyone other than (i) the owner of such Unit (or itsbeneficial owner, if the Unit is owned in trust), (ii) a member of the immediate family ofsuch Unit Owner (wife, husband, child or sibling) and his or her spouse and children, ifany, or (iii) a tenant of such Unit Owner pursuant to a lease made in accordance with therequirements of the Condominium Declaration. The Board shall have the right to evictanyone in possession of a Unit in violation of this rule.

    Pest Control

    Residents should report the presence of bugs or other pests to the Management Officeimmediately. There is no charge for pest control.

    Pets

    Section 2.21(t) of the Declaration provides:No animals shall be raised, bred, or kept in any Unit, except for dogs and

    household cats, which, in either case, do not exceed thirty-five (35) pounds in weight, andsmall birds owned as household pets by Unit Owners; provided, however, that no suchpet shall be kept for any commercial purpose; that each such pet shall be kept in strictaccordance with the administrative rules and regulations relating to household pets fromtime to time adopted or approved by the Board; that no pet shall be allowed to run in anylandscaped u.ru of the Property; and that no such pet shall, in the judgement of the Board,constitute a nuisance to others. If any pet, receives numerous complaints because ofcontinuous and repeated barking, whining, crying, damage to the Association property,overly aggressive behavior, or any other disturbance, the pet's owner will be notified bytvtanagemint of the complaint and will be given an opportunity to correct the problem. Ifthe disturbance continues unabated after notification, it shall constitute a nuisance andthus a violation of this rule. The owner of such a pet must remove the pet at his/her ownexpense within three (3) days of notice of violation'

    l. Pets shall not be allowed out of the units unless carried, shortJeashed or cagedand in the custody of a responsible person at all times while in common elements.

    2. Dogs may never be taken out of or brought into the building through the frontlobby, even if they are caged or leashed. Dogs must be taken out of and broughtinto the building by accessing the loading dock or garage entrances only'

    3. Pets must be carried, short-leashed or caged on the service elevator. Pet ownershould wait for an elevator with few or no passengers when transporting animals.

    4. Pets shall not be curbed on exterior building walls, steps, shrubbery, and flowers,small trees or lawn areas that arc part of the property. At all times during whichthe pet is in the cornmon elements or on Association-owed property, the pet mustbe short-leashed.

    5. The pet's owner or keeper must carry paper toweling, plastic bags, or other meansof wiste disposal. It is the responsibility of pet owners or walkers to immediatelyclean up after the pet's waste and properly dispose of it'

    6. Staining of hall or service elevator carpeting must be reported immediately so thatit can be cleaned effectively. The pet's owner is responsible for the cost ofcleaning or repairing carpet stains or other damage to common elements causedby the pet, and will be assessed the cost of any repairs.

    7 . Pet owners are responsible for any personal injury andlor any property damagecaused by their pet. Any party so injured or damaged shall indemniff theAssociation and its agents, and hold them harmless against any loss or liability ofany kind that might arise from damage caused by the pets with the condominiumproperty.

    No unattended pets will be allowed in the common areas and no pets arepermitted in the lobby, management office, mailbox area, fitness center, businesscenter, club room, all commercial space, and sun/roof deck.

    It is incumbent on pet owners to take care not to infringe upon the peace, comfort,and enjoyment of other residents or guests.Pet owners are encouraged to be familiar with and follow all City ordinancesrelevant to keeping a pet in Chicago. Pet owner is subject to Association finesdue to violations (see Fine Schedule).

    Receiving Room

    Packages such as U.P.S., Federal Express and other national delivery services are held in

    the receiving room. A key-tag will be inserted in your mail box notifring you of packagedelivery and holding slot number. The receiving room hours of operation are Mondaythru Friday 7:00 a.m. to 6:00 p.m. and 9:00 am to 3:00 p.m. Saturday. Closed for lunchdaily from 12:30 p.m. to 1:15 p.m. Closed on Sundays and holidays.

    Remodeling (See Construction and the Remodeling/Construction Guideline Section)

    SaleslLeases

    L Both the seller and the buyer must complete all forms normally and reasonablyrequired by the Association and return them to the Management Offrce; alongwith the payment for a reasonable charge imposed by the Association before apaid assessment letter required for closing will be issued by the Association.

    2. Both the Unit owner and the tenant must complete all forms normally andreasonably required by the Association and return them to the Management Officealong with a fully executed copy of the lease.

    3. No resident may move into any Unit until the Management Office has beensupplied the appropriate documents (including, but not limited to, a copy of thepurchase or rental contract, resident information form, and a signed authorizationof receipt of these Rules and Regulations), the transfer fee and security deposit, inamounts set by the Board, have been paid, the elevator has been reserved for use,

    and the resident has had a face-to-face meeting with Management staff.Each unit owner must provide the Management Office with a copy of the deed ortitle to the unit, as well as a copy of any leases for the unit, as applicable.

    4. Paragraph l9(m) of the Condominium Declaration limits the number of unitswhich can be under lease at any time to 30o/o of the total number of units in thebuilding.

    Satellite Dishes

    1. No satellite dishes may be installed on any of the cornmon elements of thebuilding and no satellite dishes which exceeds one meter in diameter may beinstalled outside any unit.

    2. No satellite dishes which are one meter or less in diameter may be installed onlimited common elements serving a unit, such as a balcony, without priorapproval of the Board, which approval shall not be withheld provided that theuser/installer agrees to comply with reasonable requirements imposed by theBoard to accomplish a clearly defined, legitimate safety objective, applied to theextend practical in a non-discriminatory manner (which requirements shall bespecified in a document available to the unit owner upon request), and to insure,to the extent reception or transmission of an acceptable quality signal is notprecluded as a result thereof, adverse aesthetic effects such dishes might create.

    Security

    1. Lost key/key access tag must be reported immediately to the Management Office.2. Residents should not allow unauthorized non-residents access to the common

    elements. Any security concerns, including the attempt by any unauthorized non-resident to gain access in the building should be reported immediately to the DoorStafi Management Office, or Maintenance Staff.

    3. All residents and guests must identiff themselves upon request of the Door Staff.The Door Staff is instructed to stop any unauthorized persons from entering theinner core of the building.

    4. Admittance to the building lobby and the tower is by authorization of thehomeowner via Permission to Enter Form, memorandum, facsimile orinclusion of the Management Office admittance list. Requesting properidentification for example, a photo ID is appropriate and essential fromindividuals unknown to Door Staff. Door staffmust obtain prior permission byphone from resident to allow law enforcement and process servers, unless officialcourt documents require otherwise. All visitors are to be logged in. A deliveryperson must legibly sign in before permitted entry into the building or use ofbuilding cart. Residents, who expect guests on a routine basis, either provide theDoor Staff with a current list of expected guests/clients, or expect the Door Staffto call every time requesting guest/client permission to enter. There are to be noexceptions. Residents who have a problem with this procedure should be referredto Management.

    Smoking

    1. City of Chicago Ordinance and these rules prohibit smoking or carrying lightedsmoking materials in elevators.

    2. Smoking or carrying lighted smoking materials is prohibited in all commonelements of the building, including the Fitness Center, Community Room, the Sundeck, and the garage.

    Smoke Detectors

    L Smoke detectors are in every unit. They are hard wired and do not requirebattery replacement.

    2. No tampering or disconnection allowed.

    Staff

    With the exception of the Management Office personnel, all employees work forThe 530 Lake Shore Drive Condominium Association.

    1. Association employees must receive direction and guidance only from theProperty Manager.

    2. Residents experiencing problems with Association employees or services shouldfile a report with the Property Manager rather than affempt to resolve mattersthemselves.

    3. Unit owners or residents experiencing difficulties in resolving problems with theProperty Manager should contact the Managing Agent representative or the Boardof Directors in writing.

    Storage Lockers

    l. All storage lockers are pre-assigned by unit number. The approximate dimensionsof the storage locker is 3 feet wide x 4 feet deep x 7 feettall.

    2. Storage space is provided only in the storage locker rooms. Storage is notpermitted in the aisles of the locker room.

    3. Owners must provide padlock for their storage locker. In the case of unauthorizeduse, the Management Office will remove the locker contents, by forcible entry ifnecessary, and dispose of the contents without regard to the value. Neither theAssociation nor the Managing Agent is responsible for theft, loss or damage toany property stored in lockers. Residents are responsible for insuring the contentsof their storage locker.

    4. Owners/residents are responsible for cleaning and maintaining their own storagearea.

    5. If a locker is empty and not properly secured, the maintenance staff will securewith cable tie until needed by unit owner.

    6. Storage lockers are for the use of residents only. Use of such lockers is at theresident's risk.7. The aisles of the storage locker area must be kept clear and may not be used forthe storage of any objects. Anything left in the aisles will be removed anddiscarded without notice.

    8. According to the Chicago Fire Department regulations, explosives and flammablematerials must not be stored in the lockers. This includes, but is not limited topaint, paint thinner, aerosol cans, cleaning fluids, gasoline, excelsior and otherflammable packing materials, ammunition and liquor'

    9. The locker space must be emptied and cleaned when the resident moves from theBuilding. Neither the Association nor Managing Agent is responsible for theft,loss or damage to any property stored in lockers'

    Sundeck

    1. The sundeck is available for the exclusive use of residents and their guests.2. The sundeck is open every day from 5:00 a.m. until 12:00 a.m.3. Glass containers are not allowed on the sundeck. Beverages must be consumed in

    an unbreakable container.4. Any radio or television brought on the sundeck must be used with earphones and

    must not disturb other people.5. Running on the deck is not permitted.6. Smoking is not permitted on the sundeck.7. Parents or a responsible adult must accompany children at all times on the

    sundeck.8. The Association, Board, Management Company, and the Association employees

    disclaim any and all liability resulting from items left on the sundeck.

    Tipping

    l. Association employees do not work for tips, and tipping an employee for simplydoing his or her job is unnecessary.

    2. An Employee Holiday Fund is available each December.

    Water Furniture

    No water furniture shall be installed or placed in any unit. Water furniture includes anybed, mattress, chair, sofa, or any other item of furniture that contains any substance in aliquid state as part of its elements.
