Study urges U.S.course on UNCTAD

A major study on the Code of Liner Conduct of the UN Conference of Tradeand Development (UNCTAD) prepared for the United States Maritime Ad-ministration (MARAD), has reached certain conclusions relating to actions whichwould be taken by the United States as concerns this code. This study, similar toone prepared for the Federal Maritime Commission, recommends ratification bythe U.S. of the Liner Code (although with reservations), an active policy deliberate bilateralism, and changes in government regulations which will allowU.S.-flag steamship companies to compete on an equal basis with their foreigncompetitors.

carBureau protestsexemption plan

The Houston Port Bureau has filed comments with the Interstate CommerceCommission in Case Ex Parte No. 346 (Sub-No. 8), Proposed Boxcar Exemption.This case arose out of an original request by Consolidated Rail Corporation toexempt boxcar traffic moving via Consolidated Rail Corporation from I.C.C.regulations. The commission denied Conrail’s original petition but broadened thecase as to possible exemption of boxcar traffic through the United States.

The bureau claimed the proposed exemption would be unfair and unreasonableand cause possible discrimination to small shippers especially. The bureau claim-ed this action could lead to discrimination between ports caused by carriers favor-ing one port over another as well as discrimination between shippers caused byfavoring one shipper over another. The bureau also claimed such exemptioncould destroy the current system of competitive joint rates and routes. Therefore,the bureau urged the I.C.C. to continue regulation of boxcar traffic and not toallow exemption from regulation by Conrail or any other rail carrier.

Reagan gives moreshipping bill views

Transportation Secretary Drew Lewis has sent a letter to Senator Slade Gorton,R-Wash., Chairman of the Senate Merchant Marine Subcommittee and author ofthe Reform Bill S-1593. In the letter Secretary Lewis indicated the Reagan ad-ministration intends to back legislation to limit the F.M.C.’s direct regulatoryrole to guard against deferred rebating; allow F.M.C. control of rates of state-owned carriers of countries with communist governments; allow individual car-riers or their conferences to deal with foreign shippers’ councils only; end almostall restraints over the contract rate systems, especially between regular rates andfreight charges open to shippers agreeing to use conference lines; and eliminatepenalties for withdrawal from conferences.

The letter also reinforced views stated earlier by President Reagan calling forsupporting closed conferences, a more strictly drawn definition of antitrust-immunity for agreements, and an end to required filing of tariffs with the F.M.C.The letter claims the government intends to help U.S. flag carriers by placingthem on an equal status with foreign carriers. The Senate Commerce Committeemeanwhile has postponed markup of the bill. Thus, the bill will not be sent to thefull Senate for consideration until it can be amended to gain support of shippers,carriers and the government.

When the Yugoslavian-flag ship M/V VELEBIT made its maiden voyageto Houston, there was not enough time to officially recognize the event. Sowhen the ship returned, Capt. Slobodan Markovic treated Port Authorityofficials to a luncheon, which featured tasty Yugoslavian foods, so themaiden voyage plaque could be "officially" presented.
