l ife might offer me, would be the opportunity to serve my people and makemy own humble contribution to their freedom struggles.

The structure and organization of early African societies in this countryfascinated me very mu ch and great ly in flu enced the evo lu t ion o f my po l i t i -cal outlook. The land, then the main means of production, belonged to thewhole tribe, and there was no individual ownership whatsoever. There wereno classes, no rich or poor, and no exploitation of man by man. All men werefree and equal and this was the foundation of government. Recognition of thisgeneral principle found expression in the constitution of the council. . . .

There was much in such a society that was primitive and insecure and itcertainly could never measure up to the demands of the present epoch. Butin such a society are contained theseeds of a revolutionary democracy in whichnone will be held in slavery or servitude, and in which poverty, want, andinsecurity shall be no more. (149-50)

It is common knowledge that the conference decided that, in place of theunilateral proclamation of a republic by the white minority of South Africansonly, it would demand in the name of the African people the calling of a trulynational convention representative of all South Africans, irrespective of theircolor, black and white, to sit amicably round a table, to debate a new consti-tution for South Africa, which was in essence what the government was doingby the proclamation of a republic, and furthermore, to press on behalf of theAfrican people, that such a new constitution should differ from the consti-tu t ion o f the proposed Sou th A frican Repu bl ic by gu aranteeing democrat icrights on a basis of full equality to all South Africans of adult age. The law against which the protest was directed is the law whichestablished a republic in the Union of South Africa. . . . But in weighing upthe decision as to the sentence which is to be imposed for such an offence, the court must take into account the question of responsibility, whether it isI who am responsible or whether, in fact, a large measure of the responsibilitydoes not lie 011 the shoulders of the government which promulgated that law,

Perhaps the court will say that despite our human rights to protest, to object,to make ourselves heard, we should stay within the letter of the law. I wouldsay, Sir, that it is the government, its administration of the law, which bringsthe law into such contempt and disrepute that one is no longer concerned in thiscountry to stay within the letter of the law. I will il lustrate this from my ownexperience. The Government has used the process of law to handicap me, inmy personal life, in my career, and in my political work, in a way which iscalculated, in my opinion, to bring about contempt of the law.
