En effet, les protocoles qui ont été signés entre l’ordre des avocats, la cour d’appel et le tribunal de commerce de Paris prévoient que le fond des litiges soumis à ces chambres pourra être tranché selon le droit choisi par les parties, ce qui implique que tant les avocats que les magistrats et juges consulaires concernés devront être familiarisés avec la Common Law. Ces protocoles prévoient en outre que les pièces pourront être produites en langue anglaise et que les auditions des parties, témoins, experts et technicien pourront se dérouler en anglais, ce qui nécessite une maîtrise de l’anglais juridique et des modes de preuve très peu usités devant les juridictions civiles françaises là où ils sont classiquement mis en œuvre dans les pays de Common Law. L’objectif est donc de former les participants aux réflexes, aux concepts et au techniques issus de la Common Law, de manière à leur permettre d’appréhender les contentieux qu’ils suivront ou auront à trancher quel que soit le droit régissant le litige. Ce programme n’est pas limité aux seules personnes appelées à plaider devant ou à siéger dans les chambres commerciales internationales mais s’adresse également aux personnes, avocats ou magistrats, ayant un intérêt pour les contentieux internationaux dans lesquels la Common Law est impliquée ou souhaitant partir en détachement, par exemple. Il débutera par une introduction à l’anglais et aux modes de rédaction juridiques ainsi que par une introduction historique et aux concepts majeurs de la Common Law et se poursuivra par des modules relatifs aux droits des contrats, des « torts » (responsabilité délictuelle), des sociétés et commercial avant d’être clôturé par un cours sur les modes de preuve et le fonctionnement des interrogatoires. L’ensemble de ces enseignements sera dispensé selon la formule anglo-américaine, c’est-à-dire avec la mise à disposition des participants de matériels leur permettant de préparer chaque cours, lequel devra ainsi permettre aux intervenants de répondre aux questions que les participants auront après une première prise de connaissance des notions qui seront enseignées avant ce cours. LEGAL ENGLISH Legal English and Contract Drafting in Common Law

The course includes :

Legal English terminology, analysis and explanation of drafting techniques, use of contract terms and provisions, legal vocabulary and phrases of American/UK Commercial and Contract Law particular to international contracts in English.

William YeagoHe is the Head Teacher of the Paris EFB Language Department and an American attorney at law. He is also an Adjunct Professor of Law and Legal English at Paris I and II, as well as a Presenter, Legal Language Education Advisor and co-author at Cambridge University Assessment and Press.

Dr Ruth Sefton-GreenLiterae Humaniores (MA Oxon) is Maître de conférences of comparative private law at the Université Paris 1 (Panthéon-Sorbonne) where she obtained her PhD (1997) and teaches English law. Before that she qualified as a solicitor of the Law Society of England and Wales and was admitted to the Paris bar. She was Wainwright Senior Fellow at the Faculty of Law, McGill University (winter semester, 2012). She has also taught at Sciences Po, Paris. Her thesis La notion d’obligation fondamentale: comparaison franco-anglaise (LGJD, 2000) was awarded the Lévy-Ullmann prize for comparative law. She has published numerous articles and been the editor of several books, singly and collectively, in French, English and European law books and periodicals, on themes and issues relating to the comparative law of obligations, remedies, judicial reasoning, legal culture, European private law, social justice and more recently legal education.

Nicolas PralicaHe is a dual-qualified Avocat à la Cour and Barrister of England and Wales. He specialises in international arbitration, public international law and comparative law. He currently acts as an assistant to several arbitrators. He was also formally an associate in the international arbitration team of Dechert (Paris) LLP, and prior to that, worked in the arbitration teams at Cleary Gottlieb Steen & Hamilton and Three Crowns LLP. As such, he has significant experience in contractual disputes in the energy, construction and oil & gas sectors. He also holds a degree in mathematics and economics engineering from Ecole Polytechnique and ENSAE, and previously worked as a financial analyst at a consulting firm and as a quantitative analyst in an investment bank. As such, he is well placed to understand both the technical and legal aspects of the cases he works on.

Jago ChanterHe is an English solicitor, registered with the Paris Bar, who works at Dechert LLP. He focuses his practice on international arbitration and English law.Mr. Chanter has experience in the construction, telecommunications, defense, energy, and gaming sectors, and has advised on proceedings in the English Courts, proceedings under the ICC, LCIA, ICSID, and UNCITRAL arbitral rules, as well as pre-arbitral DAB disputes under FIDIC contracts.Mr. Chanter acts as counsel for a wide range of clients, and also sits as secretary in arbitral proceedings. He holds a first class degree from the University of Bristol, and a masters degree from Harvard Law School. Prior to moving to Paris, Mr. Chanter worked at two leading London law firms, where he concentrated on international litigation and competition law, and completed two secondments to international banks.

Lord Goldsmith QCHe is QC, London Co-Managing Partner and Chair of European and AsianLitigation, joined Debevoise in 2007. He is a graduate in law from Cambridge University with double first–class honours and a master’s from University College London. He was admitted to he Bar of England & Wales in 1972 and New South Wales in 2010.

Samantha J.RoweShe is a partner in the International Dispute Resolution and Business Integrity Groups, whose practice focuses on international arbitration and public international law. She advises clients on a broad range of international law issues, including the international protection of investments, and represents her clients in associated disputes. Ms. Rowe received her B.A. (Hons.) with First Class Honors in English Law and French Law from the University of Oxford, Wadham College, a Certificat Supérieur de Droit Français from the Université de Paris II Panthéon-Assas, and an LL.M. in International Legal Studies from New York University. She was a scholar of Wadham College and received a Dean’s Graduate Award at NYU.

Patrick TaylorHe is is a partner in the International Dispute Resolution Group. Mr. Taylor graduated with an LL.B. honours law degree from Cambridge University in 2001 and was admitted as a solicitor in England & Wales in 2005 and in Ireland in 2017. He is bi-lingual English/French, and has a working knowledge of Spanish.

Antoine F. KirryHe is a partner based in the Paris office and a member of the firm’s Litigation Group. Mr. Kirry has substantial litigation and arbitration experience, with particular emphasis on M&A-related disputes. Mr. Kirry received a Licence d’Histoire and a Maîtrise en Droit des Affaires in 1981 and a D.E.A. en Droit Privé in 1982 from the University of Strasbourg, and a LL.M. from Columbia Law School in 1986. He is a member of the Paris and New York Bars.

Alexandre BischHe is an international Counsel. William H. Taft VHe based in the firm’s New York office, is a partner in the Litigation Department. His practice focuses on commercial and corporate governance litigation and international arbitration. Mr. Taft was admitted to the New York Bar in 2005. He is a member of the American Society of International Law and has served on the International Disputes Committee of the New York City Bar Association (2010–2013). He currently serves on the Corporation Law Committee of the New York City Bar Association, the Program Committee of the Federal Bar Council, the board of The Fund For Modern Courts, and the board of Manhattan Legal Services.

Ina C. PopovaShe is a partner in the firm’s International Dispute Resolution Group who focuses on international arbitration and litigation and public international law. Ms. Popova is admitted to practice in Paris and New York and holds advanced degrees in English law. In addition to graduate degrees from Harvard Law School and from the University of Cambridge, Ms. Popova received her B.A. (Hons.)(Cantab.) with First Class Honours in Law (Double Maîtrise) from the University of Cambridge, Trinity College, and her Maîtrise en droit comparé, mention droits anglais et français with high honors from the Université de Paris II Panthéon-Assas. EVIDENTIARY RULES AND TAKING OF EVIDENCES IN COMMON LAW : EXPERTS, WITNESSES, CROSS-EXAMINATION

Evidence collection and disclosure is one of the main areas of procedural and cultural diversity between civil law and common law systems. Differing approaches to key elements, such as the balance between inquisitorial or adversarial methods, or the requirement of an adversarial testimony, have a major impact on proceedings and their conduct.The international chamber of the Paris Court of Appeals has undertaken to develop procedures inspired by the common law systems. This is a key feature of its attractiveness as an international forum.The purpose of this training session is to introduce participants to the typology and rules for the taking of evidence in common law systems and to initiate them, through practical exercises, to the main procedures and techniques used at hearings, including the examination of witnesses and experts (direct examination and cross-examination).This training session is given by partners of Quinn Emanuel Urquhart & Sullivan whose practice involves using these common law techniques on a daily basis.

Kami HaeriHe is a Partner Paris Office. Kami Haeri joined the firm’s Paris office in 2017 as Chair of Commercial Litigation and White Collar prac-tices. Previously, he chaired August Debouzy’s Litigation, Arbitration, and White Collar Practice. In 1997, Kami was appointed to the prestigious Conférence du Stage, the French Bar’s 200+ year old moot court competition, which annually selects the 12 best candidates out of more than 150 applicants. Kami is a former member of the Paris Bar council, where he served from 2011 to 2013. Kami also regularly serves on the faculty of several Universities and Institutions: he teaches “Dispute Resolution” at Sciences-Po Paris, “Litigation Strategies and Tactics” at the Paris Bar School and “Criminal Procedure” at the University of Cergy. As an attorney, Kami has lectured on a variety of subjects including compliance, criminal liability of entities, class actions, digital transformation in the legal professions, trial practice and cri-minal law. In October 2016, French Minister of Justice Jean-Jacques Urvoas commissioned Kami to draft a comprehensive report on “The Future of French Lawyers”. The 130-page report includes 50 proposals covering topics such as legal education, ethics, digital transformation, management of law firms and has garnered much praise within the legal community in France and across Europe.

Michael YoungHe is a Partner and Queen’s Counsel specialising in international arbitration. He is one of the leading practitioners in the market worldwide, joining Quinn Emanuel in 2017 from Allen & Overy LLP (where he was Global Co-Head of their arbitration practice). He is a first-class law graduate of both Cambridge and Oxford Universities, and acts as a Vice-President of the ICC Court of Arbitration. He is a leading advocate – re-gularly arguing cases before arbitral tribunals and experts – and has been on the Executive Committee of the Federation for International Arbitration Advocacy since its inception (where he has taught advocacy classes around the world). Michael sits frequently as an arbitrator himself. He has also written and spoken widely on arbitration issues, as well as teaching at the Faculty of Law at Sciences Po in Paris and at the University of London LLM arbitration programme.
