The buying procedure in Spain is quite simple, but it may differ from what you know from home. There are details left out of this short introduction, and we recommend that you seek professional assistance to avoid unnecessary problems.

1. Reservation To take the property ‘off-market’ the buyer deposits approx. € 5,000 and signs a simple reservation document stating the property, price and payment details. The document is confirmed with the vendor’s signature.

2. Private Purchase ContractApprox. 10 - 15 days after the deposit has been paid, and after the nota simp-le (certificate from the Land Registry) has been acquired, a private purchase contract can be signed. The private contract is a binding document, securing both the vendor and the buyer. The contract specifies the property, payment schedule etc.

Typically 10% of the purchase price is paid directly to the vendor or developer, less the deposit already paid.

3. Sales Title Deed (Escritura)Buyer and vendor, or representatives, proceed to the Notary, where the remainder of the purchase price is paid and the Title Deed is signed. The keys are then handed over to the buyer at the Notary, and the buyer can take possession and move into the property.

The costs of the Notary, transfer tax etc. is paid and the Title Deed (escritura) is sent to the registry. In general the costs of buying a property are 10% plus costs of the mortgage.

Benalmádena is a special town, origi-nally three areas: Benalmádena Pueblo, Arroyo de la Miel and Benalmádena Costa.

Benalmádena is located at the foot of the mountains Sierra de Mijas. There are only 15 kms (10 miles) to Malaga Airport, and the motorway is on the hillside giving easy access to the neighbouring towns and villages.

Commuting by bus and train is also easy. The train runs along the coast between Fuengirola and Malaga, and stops in Benalmádena every 30 minutes. If you are planning to buy a property for rental, Benalmádena is ideal as the holiday guests do not need to rent a car.

Benalmádena PuebloThis is a typical beautiful Spanish village (pueblo) with narrow streets and old houses. The tourism has not yet reached the old part of Benalmádena as it is drawn back from the busy beaches, even though it is close to the main attractions of the area.

Arroyo de la MielThis area has now turned in to the town centre of Benalmádena. It is rich in small restaurants and shops, and in the middle of everything you can find Tivoli, one of the main attractions.

Tivoli has entertainment for all ages, offering great fun for the family.

The cable car is located next to Tivoli, taking you to the top of the mountain where you can enjoy spectacular views of the coast and the sea.

Benalmádena CostaAs the name indicates, this part is located on the sea front, stretching several miles in both directions. This is where you find the beaches and lots of life in the summer.

The famous sports harbour, Puerto Marina, is particularly well-known for the cosy atmosphere and the beautiful architecture. This is a lively place with more than 1000 moorings and all sorts of water sports: sailing, water ski, big-game fishing, diving etc.

BudgetHow much are you willing to spend? Does it depend on a mortgage, and how much are you willing to spend every month including the expenses of ownership?

Location Distance to shops, restaurants, beach, swimming pool, golf courses, airport, and last but not least, how far is it to visit people you already know on the coast?

ViewsDo you require special views? Many properties offer sea views or mountain views – or both.

Outside areasGarden, pool, open or covered terrace. Partly covered is often the best, as the sun is strong in the summer.Most properties are located in a com- munity (urbanisation) offering different services and levels of security.

Type of propertyDo you prefer villa, apartment, pent-house apartment, townhouse, detached or semi-detached? Is it for full time residence or for holidays?

Looking after the propertyWho looks after the property when you are not here? There are many companies and private individuals who specialise in taking care of properties when the owners are away.

LettingIs it okay to share your property with holiday guests? The rental income can contribute to, or pay all, the costs as-sociated with owning your property on Costa del Sol.

You should have a good administrator to take care of the rental, and CASA:UNA is happy to assist with introduction and marketing of the property. Choosing east or west of Malaga

Most of us know the western part of Costa del Sol with great flamenco dance shows, concerts with international per-formers, horse racing, casinos, Tivoli, night clubs, and of course natural parks and much more.

FuengirolaScandinavians have chosen the Fuengi-rola area as their main focus when they become residents on Costa del Sol. There is a large Spanish population, however English is spoken almost everywhere. The town has lovely golden beaches with both traditional and modern restaurants. Fuengirola has a wide selection of shops to cater for all nationalities, and is known to be the place to find national specialities from any European country.

BenalmádenaBenalmádena has the best offerings of activities on the Costa del Sol. You can choose the Casino, Tivoli, golf and the amazing sports harbour Puerto Marina built in Arabic style. Also you can take the cable car to a bird reserve on top of one of the mountains behind the town.

Benalmádena is made up of three parts.1) Benalmádena Pueblo located high on a hill. It has narrow streets and old town houses. This is a typical old-style Spanish town. 2) In Arroyo de la Miel you have Tivoli and a lot of small restaurants and shops. Arroyo has become the town centre for Benalmádena.

3) Benalmádena Costa is the coastal part with plenty of large sandy beaches, and the sports harbour is full of life and atmosphere.

MarbellaIf you survive the shopping in all the fashionable shops, you can enjoy a lunch in the Orange Square at the centre of Marbella. The old town of Marbella has many narrow streets with all kinds of little shops and restaurants. The nightlife is catering for the jet set of Europe.

East of MalagaThe area is not as developed as much as the western part of Costa del Sol, but it has lovely nature. The Andalusian government has decided to preserve much of the original habitat.

Torre del MarMost of the small towns in the area use Torre del Mar for shopping and going to the beach. The town has several kilo- metres of promenade and wide golden beaches. The supermarkets are big, the restaurants are superb, and the nurseries have any tropical plant you might wish for.

Nerja – Balcón de EuropaNerja is known by many as a lovely Spanish village on the coast, offering peace and tranquility, easy Spanish life style and wonderful beaches. The town centre is rich with restaurants and cafés, and much of the life is centred around

the town square and “Balcón de Europa” with panoramic views of the sea and the coastline in both directions.

AlmuñécarThe “final frontier” of the Costa del Sol, or some say that Almuñécar is on “Costa Tropical” offering the best and mildest climate in the south of Spain. The new motorway has recently been extended to include Almuñécar giving easy access to the airport in Malaga.

Nerja - easy living!

Nerja is located east of MalagaNerja lies on the coast approx. 50 kilo-metres east of Málaga and the town is well connected to the airport via the new motorway.

Amazing cavesNerja's main attraction is the fascinating caves, located about 3 kilometres from Nerja town centre and is very well signposted. One of the main caverns has been transformed into a concert hall, where many performances are

staged during the summers. The biggest cavern has an enormous stone structure many metres wide. Everything is well lit up and easy to access on foot. The caves are closed for the siesta.

Burriana BeachGolden beaches, restaurants and bars, diving centre and many other water sports make Burriana Beach one of the favourite destinations in the area.

Nerja is probably the most established town in the region east of Malaga, with narrow winding streets containing restaurants and shops. Almuñécar

The main towns of Costa Tropical are La Herradura and Almuñécar. This relatively unknown part of the coast line belongs to the province of Granada.

The old town centre of Almuñécar is rich in historical sites, and the heart of Almuñécar is located around the Castillo San Miguel, which gives its name to the old quarter, "Castillo" or "San Miguel".

The locals enjoy their traditions and fiestas to the full, and it is impossible to stay here and not fall into the same pace of life.

MuseumsCulture from the Bronze Age, the Pho-enicians, the Romans, the Moors and the Christians, along with their artifacts, are to be found in the town’s museums.

The Spaniards have 2-3 years longer life expectancy than the North Euro-peans. Whether it is the sun, siesta, red wine or olive oil it is hard to say. However some of the Scandinavian countries send patients to Spain for rehabilitation as experience has shown that it is easier to recover in the sun.

Your health enjoys the sunAsthma, arthritis and many other health- related problems fare much better in the mild climate of Southern Spain. For many people this is the main reason for moving to Costa del Sol.

The climate is mild with winter tempe-ratures generally not lower than 10oC, and summer temperatures seldom higher than 35oC. On average you will find more than 300 sunny days, and less than 20 wet days per year.

Your free timeDifferent clubs, sports or cultural activi-ties are here to fill your free time. It can be playing bridge or golf, taking a hike in the mountains, attending concerts and much more. Several business clubs are available where people meet for net-working and to exchange experiences.

Selection in the shopsDue to the large international society on Costa del Sol, almost any local speciality from home is available, especially in the towns of Fuengirola and Mijas.

Children are firstThere are many International Schools on Costa del Sol, and local Spanish schools are also quite good.

In any case, the children are always the first to learn the language!

NIE-numberForeign Identification Number (Nú-mero de Identificación de Extranjero) is required to buy a property in Spain. The original document must be pre-sented to the notary when signing the Title Deed (escritura) so make sure you apply for your NIE number well ahead of time. The NIE number is issued by Policia National or at the Spanish em-bassy in your home country.

Health insuranceThis is an important topic and you have to pay attention to the small print. Private health insurance is not that expensive in Spain, though it does depend on your medical condition and age. The public health system is excel-lent, however with a private insurance you have a choice of hospitals and doc-tors speaking your own language.

Many flight connectionsCosta del Sol is a popular destination and has been for many years. Prices are low, and if you can order well ahead of departure, you might find that the prices are so low that it makes transport and parking at home more expensive than the flight itself.

Flight connections are available from almost any airport in the United King-dom and Ireland, and also all other major cities in Northern Europe are well connected to the Costa del Sol.

Most people fly in to Malaga, however Gibraltar can be quicker if you live in Estepona or Sotogrande in the far west of Costa del Sol. Granada may also be another option for those visiting Almuñécár or La Herradura in the far eastern parts.

Spain is not an expensive country to live in. Here is an overview of the expenses related to ownership of a property in Spain.

Real Estate Tax (IBI) Paid every year to the local municipal authority (City Hall) and is payable by all property owners.

Rubbish collection tax (Basura)The amount payable varies from one municipality to another. Paid yearly, normally at the same time as the IBI.

Community fees (Comunidad de Propietarios)Generally this includes the common areas such as garden, pool, street lights, building corridors, fences, foundations, roof, entrance areas, parking zones, tennis court, etc.

Normally paid twice a year but can vary.

Water (Agua)This is paid directly to the local water company or in some cases via the community fees.

Electricity (Sevillana/Endesa)The electricity is paid every month directly to the electricity company.

Telephone (Telefónica)The telephone company is paid every month if you have a fixed line or ADSL.

Wealth Tax (Impuestos sobre el Patrimonio)Owners of properties in Spain are required to file a return for the tax on the properties owned in Spain on December 31st of each year.

Expenses of ownership

An important fact is that the Spanish tax authorities do not send out a tax form to you. It is your responsibility to request the tax return form and fill it in on time. If you are a non-resident living in Spain for more than 183 days, you will automatically be considered as resident for tax purposes, even if you do have not have a residence permit.

Do you have to pay tax?Are you making more than € 21,035.42 a year in Spain? Then you are obliged to make an income tax declaration. The tax structure is progressive and the tax period follows the calendar year. Tax is different if you are a non-resident or a tax resident in Spain. The cadastral value (valor catastral) is the rateable value of a property as determined by the municipal government.

Owning a propertyYou will also have to fill in a tax declaration if you own a property in Spain. Also there is a tax on estimated

rental value unless this is your main residence and you are a tax resident. If the property is rented out you have to declare the rental income.Local property tax “Impuesto Sobre Bienes Inmuebles (IBI)” is an annual tax of 0.5% of the cadastral value.

Wealth taxAs a property owner you are liable to Wealth Tax (Impuesto sobre el Patrimo-nio) also calculated of the cadastral value.

Income taxPersonal Income Tax (Impuesto sobre la renta de las personas físicas/IRPF) is the tax on personal income.

Return on capitalThere is a flat rate of 18% interest income, dividends and capital gains including shares and property.

Inheritance TaxAll property owners should have a Spanish will signed at a notary and

registered at the “Registro de Actos de Ultima Voluntad”. It can be a slow process to get a foreign will recognized in Spain, and it is easier for your heirs to get your property in Spain transferred, if you have a Spanish registered will.

Selling your propertyWhen you sell your property you have to pay capital gains tax on the difference of the value on the title deed when you bought and when you sell. From January 2007 the capital gains tax is 18% for both residents and non-residents. There is a small tax payable for the land appreciation “Plus valia” depending on period of ownership and the cadastral value.

Please note that there are reductions for long period of ownership, re-investment and senior citizens (65 years) which may apply. Please contact a tax advisor.

Mortgages are available from both lo-cal Spanish banks and international banks "well established" on Costa del Sol. Most of the banks have good local knowledge and can give an answer in a short time.Mortgages are offered as variable or fixed-rate interest, and you can have interest only for a few years or up to the full period.

How much can I get?The mortgage is normally 60 - 90% of the property value depending on the bank and your financial situation and age. Some banks work without age limit, and other banks also require the

declared title deed value to be higher than the amount borrowed. Young buyers enjoy special conditions in Spain, allowing for mortgages to buy the first home even if there are difficulties meeting the normal income requirements.For large properties it is often recom-mended to take out a mortgage for tax reasons, offered at very good rates via international banks or private banking.

CostsValuation of the property is made by an independent party (€ 300 - 1000). The opening fee depends on the bank, but normally ½ - 1% of the mortgage

amount. Stamp duty of 0.5% and a fee to the Notary and the Registry. Most banks also require insurance on the property and/or life insurance.
